AN ACT

  

1

Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An

2

act relating to insurance; amending, revising, and

3

consolidating the law providing for the incorporation of

4

insurance companies, and the regulation, supervision, and

5

protection of home and foreign insurance companies, Lloyds

6

associations, reciprocal and inter-insurance exchanges, and

7

fire insurance rating bureaus, and the regulation and

8

supervision of insurance carried by such companies,

9

associations, and exchanges, including insurance carried by

10

the State Workmen's Insurance Fund; providing penalties; and

11

repealing existing laws," in long-term care, further

12

providing for definitions and for outline of coverage

13

provisions; providing for adverse decisions, for complaints,

14

for utilization review, for grievances and for prompt

15

processing and payment of claims; further providing for

16

authority to promulgate regulations; and providing for annual

17

report.

The General Assembly of the Commonwealth of Pennsylvania

19

hereby enacts as follows:

20

Section 1.  The definition of "long-term care insurance" in

21

section 1103 of the act of May 17, 1921 (P.L.682, No.284), known

22

as The Insurance Company Law of 1921, amended July 17, 2007

23

(P.L.134, No.40) is amended and the section is amended by adding

definitions to read:

Section 1103.  Definitions.--As used in this article, the

3

following words and phrases shall have the meanings given to

4

them in this section:

5

"Adverse decision."  A determination by a long-term care

6

insurance policy issuer that results in denial of payment of

7

benefits. The term includes the failure to pay a clean claim

8

within forty-five (45) days of receipt of the clean claim.

"Clean claim."  A claim for payment for a health care service

11

which has no defect or impropriety. A defect or impropriety

12

shall include lack of required substantiating documentation or a

13

particular circumstance requiring special treatment which

14

prevents timely payment from being made on the claim. The term

15

shall not include a claim from a health care provider who is

16

under investigation for fraud or abuse regarding that claim.

"Complaint."  A dispute or objection regarding the coverage,

19

operations or management policies of a long-term care insurance

20

issuer, which has not been resolved by the long-term care

21

insurance issuer and has been filed with the long-term care

22

issuer or with the Department of Health or the Insurance

23

Department. The term does not include a grievance.

24

"Concurrent utilization review."  A review by a utilization

25

review entity of all reasonably necessary supporting

26

information, which occurs during a policyholder or certificate

27

holder's course of treatment and results in a decision to

28

approve or deny payment for the health care service.

"Grievance."  A request by a policyholder, certificate holder

or health care provider, with the written consent of the

2

policyholder or certificate holder, to have a long-term care

3

insurance issuer or utilization review entity reconsider a

4

decision solely concerning the medical necessity and

5

appropriateness of a health care service. If the long-term care

6

insurance issuer is unable to resolve the matter, a grievance

7

may be filed regarding the decision that:

8

(1)  disapproves full or partial payment for a requested

9

health care service;

10

(2)  approves the provision of a requested health care

11

service for a lesser scope or duration than requested; or

12

(3)  disapproves payment for the provision of a requested

13

health care service but approves payment for the provision of an

14

alternative health care service. The term does not include a

15

complaint.

"Health care provider."  A licensed hospital or health care

18

facility, medical equipment supplier or person who is licensed,

19

certified or otherwise regulated to provide health care services

20

under the laws of this Commonwealth, including a physician,

21

podiatrist, optometrist, psychologist, physical therapist,

22

certified nurse practitioner, registered nurse, nurse midwife,

23

physician's assistant, chiropractor, dentist, pharmacist or an

24

individual accredited or certified to provide behavioral health

25

services.

"Health care service."  Any covered treatment, admission,

27

procedure, medical supplies and equipment or other services,

28

including behavioral health, prescribed or otherwise provided or

29

proposed to be provided by a health care provider to a

30

policyholder or certificate holder under a long-term care

insurance contract.

"Long-term care insurance."  Any insurance policy or rider

3

advertised, marketed, offered or designed to provide

4

[comprehensive] coverage for each covered person on an expense-

5

incurred, indemnity, prepaid or other basis for functionally

6

necessary or medically necessary diagnostic, preventive,

7

therapeutic, rehabilitative, maintenance or personal care

8

services provided in a setting other than an acute care unit of

9

a hospital. The term includes a policy, rider or prepaid home

10

health or personal care service policy [which provides for

11

payment of benefits based upon cognitive impairment or the loss

12

of functional capacity]. The term includes group and individual

13

policies or riders issued by insurers, fraternal benefit

14

societies, nonprofit health, hospital and medical service

15

corporations, health maintenance organizations or similar

16

organizations. The term does not include any insurance policy

17

which is offered primarily to provide basic Medicare supplement

18

coverage, basic hospital expense coverage, basic medical-

19

surgical expense coverage, hospital confinement indemnity

20

coverage, major medical expense coverage, disability income

21

protection coverage, accident-only coverage, specified disease

22

or specified accident coverage or limited benefit health

23

coverage.

"Prospective utilization review."  A review by a utilization

26

review entity of all reasonably necessary supporting information

27

that occurs prior to the delivery or provision of a health care

28

service and results in a decision to approve or deny payment for

29

the health care service.

30

"Retrospective utilization review."  A review by a

utilization review entity of all reasonably necessary supporting

2

information which occurs following delivery or provision of a

3

health care service and results in a decision to approve or deny

4

payment for the health care service.

5

"Utilization review."  A system of prospective, concurrent or

6

retrospective utilization review performed by a utilization

7

review entity of the medical necessity and appropriateness of

8

health care services prescribed, provided or proposed to be

9

provided to a policyholder or certificate holder. The term does

10

not include any of the following:

11

(1)  Requests for clarification of coverage, eligibility or

12

health care service verification.

13

(2)  A health care provider's internal quality assurance or

14

utilization review process unless the review results in denial

15

of payment for a health care service.

16

"Utilization review entity."  Any entity certified pursuant

17

to section 1111.3 that performs utilization review on behalf of

18

a long-term care insurance issuer.

19

Section 2.  Section 1111 of the act, added December 15, 1992

20

(P.L.1129, No.148), is amended to read:

21

Section 1111.  Outline of Coverage Provisions.--(a)  An

22

outline of coverage shall be delivered to a prospective

23

applicant for long-term care insurance at the time of initial

24

solicitation through means which prominently direct the

25

attention of the recipient to the document and its purpose.

26

(b)  The department shall prescribe a standard format,

27

including style, arrangement and overall appearance, and the

28

content of an outline of coverage.

29

(c)  In the case of agent solicitations, an agent must

30

deliver the outline of coverage prior to the presentation of an

application or enrollment form.

2

(d)  In the case of direct response solicitations, the

3

outline of coverage must be presented in conjunction with any

4

application or enrollment form.

5

(e)  The outline of coverage shall include all of the

6

following:

7

(1)  A description of the benefits and coverage provided in

8

the policy.

9

(2)  A statement of the exclusions, reductions and

10

limitations contained in the policy.

11

(3)  A statement of the terms under which the policy or

12

certificate may be continued in force or discontinued, including

13

any reservation in the policy of a right to change premium.

14

Continuation or conversion provisions of group coverage shall be

15

specifically described.

16

(4)  A statement that the outline of coverage is a summary

17

only, not a contract of insurance, and that the policy or group

18

master policy contains governing contractual provisions.

19

(5)  A description of the terms under which the policy or

20

certificate may be returned and premium refunded.

21

(6)  A brief description of the relationship of cost of care

22

and benefits.

23

(7)  A summary of the long-term care insurance policy's

24

utilization review policies and procedures.

25

(8)  A summary of all complaint and grievance procedures used

26

to resolve disputes between the long-term care insurance policy

27

issuer and a policyholder, certificate holder or a health care

28

provider, including:

29

(i)  The procedure to file a complaint or grievance as set

30

forth in this article, including a toll-free telephone number to

obtain information regarding the filing and status of a

2

complaint or grievance.

3

(ii)  The right to appeal a decision relating to a complaint

4

or grievance.

5

(iii)  The right of a policyholder or certificate holder to

6

designate a representative to participate in the complaint or

7

grievance process as set forth in this article.

8

(iv)  A notice that all disputes involving denial of payment

9

for benefits will be decided by qualified personnel with

10

experience in the same or similar scope of practice and that all

11

notices of decisions will include information regarding the

12

basis for the determination.

13

(f)  An additional copy of the outline of coverage required

14

by subsection (a) shall be provided to consumers:

15

(i)  at least once every five (5) years beginning upon the

16

policyholder's or certificate holder's sixtieth birthday;

17

(ii)  upon receipt by the long-term care issuer of the first

18

claim for benefits under the policy filed by the policyholder or

19

certificate holder.

20

Section 3.  The act is amended by adding sections to read:

21

Section 1111.1.  Adverse Decisions.--When a long-term care

22

insurance issuer renders an adverse decision, the issuer shall

23

send, within five (5) working days after the adverse decision

24

has been made, a written notice to the policyholder or

25

certificate holder that states:

26

(1)  The specific factual basis, in clear, understandable

27

language for the issuer's decision.

28

(2)  The specific criteria and standards on which the

29

decision was based.

30

(3)  The policyholder's or certificate holder's right to

appeal the adverse decision.

2

(4)  The right of a policyholder or certificate holder to

3

designate a representative to participate in the complaint or

4

grievance process as set forth in this article.

5

(5)  The procedure to file a complaint or grievance, as

6

applicable.

7

(6)  The issuer's toll-free telephone number to obtain

8

information regarding the filing and status of a complaint or

9

grievance.

10

Section 1111.2  Complaints.--(a)  (1)  An issuer of a long-

11

term care insurance policy shall establish and maintain an

12

internal complaint process with two levels of review by which a

13

policyholder or certificate holder shall be able to file a

14

complaint regarding a participating health care provider or the

15

coverage, operations or management policies of the long-term

16

care insurance policy issuer.

17

(2)  The complaint process shall consist of an initial review

18

to include all of the following:

19

(i)  A review by an initial review committee consisting of

20

one or more employes of the long-term care insurance policy

21

issuer.

22

(ii)  The allowance of a written or oral complaint.

23

(iii)  The allowance of written data or other information.

24

(iv)  A review or investigation of the complaint which shall

25

be completed within thirty (30) days of receipt of the

26

complaint.

27

(v)  A written notification to the policyholder or

28

certificate holder regarding the decision of the initial review

29

committee within five (5) business days of the decision. Notice

30

shall include the basis for the decision and the procedure to

file a request for a second level review of the decision of the

2

initial review committee.

3

(3)  The complaint process shall include a second level

4

review that includes all of the following:

5

(i)  A review of the decision of the initial review committee

6

by a second level review committee consisting of three or more

7

individuals who did not participate in the initial review. At

8

least one-third of the second level review committee shall not

9

be employed by the long-term care insurance policy issuer.

10

(ii)  A written notification to the policyholder or

11

certificate holder of the right to appear before the second

12

level review committee.

13

(iii)  A requirement that the second level review be

14

completed within thirty (30) days of receipt of a request for

15

such review.

16

(iv)  A written notification to the policyholder or

17

certificate holder regarding the decision of the second level

18

review committee within five (5) business days of the decision.

19

The notice shall include the basis for the decision and the

20

procedure for appealing the decision to the department or the

21

Department of Health.

22

(b)  (1)  A policyholder or certificate holder shall have

23

fifteen (15) days from receipt of the notice of the decision

24

from the second level review committee to appeal the decision to

25

the department or the Department of Health, as appropriate.

26

(2)  All records from the initial review and second level

27

review shall be transmitted to the appropriate department in the

28

manner prescribed. The policyholder, certificate holder, the

29

health care provider or the long-term care insurance policy

30

issuer may submit additional materials related to the complaint.

(3)  The appropriate department shall determine whether a

2

violation of this article has occurred and may impose any

3

penalties authorized by this article.

4

(c)  Nothing in this article shall prevent the department or

5

the Department of Health from communicating with the

6

policyholder, certificate holder, the health care provider or

7

the long-term care insurance policy issuer as appropriate to

8

assist in the resolution of a complaint. Such communication may

9

occur at any time during the complaint process.

10

(d)  At any time throughout the complaint process in any

11

forum, the policyholder or certificate holder may be assisted or

12

represented by an attorney, Department of Aging long-term care

13

insurance ombudsman or representative, or other individual.

14

Section 1111.3  Utilization Review.--(a)  (1)  A utilization

15

review entity may not review health care services delivered or

16

proposed to be delivered in this Commonwealth pursuant to a

17

long-term care insurance policy unless the entity is certified

18

by the Department of Health to perform utilization review. A

19

utilization review entity operating in this Commonwealth on or

20

before the effective date of this section shall have one (1)

21

year from the effective date of this section to apply for

22

certification.

23

(2)  The Department of Health shall grant certification to a

24

utilization review entity that meets the requirements of this

25

section. Certification shall be renewed every three (3) years

26

unless otherwise subject to additional review, suspension or

27

revocation by the department.

28

(3)  The Department of Health may adopt a nationally

29

recognized accrediting body's standards to certify utilization

30

review entities to the extent the standards meet or exceed the

standards set forth in this article.

2

(4)  The Department of Health may prescribe application and

3

renewal fees for certification. The fees shall reflect the

4

administrative costs of certification and shall be deposited in

5

the General Fund.

6

(b)  (1)  A utilization review entity shall do all of the

7

following:

8

(i)  Respond to inquiries relating to utilization review

9

determinations by:

10

(A)  providing toll-free telephone access at least forty (40)

11

hours per week during normal business hours;

12

(B)  maintaining a telephone answering service or recording

13

system during nonbusiness hours; and

14

(C)  responding to each telephone call received by the

15

answering service or recording system regarding a utilization

16

review determination within one (1) business day of the receipt

17

of the call.

18

(ii)  Protect the confidentiality of the medical records of a

19

policyholder or certificate holder in compliance with all

20

applicable Federal and State laws and regulations and

21

professional ethical standards.

22

(iii)  Ensure that a health care provider is able to verify

23

that an individual requesting information on behalf of the long-

24

term care insurance policy issuer is a legitimate representative

25

of the long-term care insurance policy issuer.

26

(iv)  Conduct utilization reviews based on the medical

27

necessity and appropriateness of the health care service being

28

reviewed and provide notification within the following time

29

frames:

30

(A)  A prospective utilization review decision shall be

communicated within two (2) business days of the receipt of all

2

supporting information reasonably necessary to complete the

3

review.

4

(B)  A concurrent utilization review decision shall be

5

communicated within one (1) business day of the receipt of all

6

supporting information reasonably necessary to complete the

7

review.

8

(C)  A retrospective utilization review decision shall be

9

communicated within thirty (30) days of the receipt of all

10

supporting information reasonably necessary to complete the

11

review.

12

(v)  Ensure that personnel conducting a utilization review

13

have current licenses in good standing or other required

14

credentials, without restrictions, from the appropriate agency.

15

(vi)  Provide all decisions in writing to include the basis

16

and clinical rationale for the decision.

17

(vii)  Notify the health care provider of additional facts or

18

documents required to complete the utilization review within

19

forty-eight (48) hours of receipt of the request for review.

20

(viii)  Maintain a written record of utilization review

21

decisions adverse to policyholders or certificate holders for

22

not less than three (3) years, including a detailed

23

justification and all required notifications to the health care

24

provider and the policyholder or certificate holder.

25

(2)  Compensation to any person or entity performing

26

utilization review may not contain incentives, direct or

27

indirect, for the person or entity to approve or deny payment

28

for the delivery of any health care service.

29

(3)  Utilization review that results in a denial of payment

30

for a health care service shall be made by a licensed physician,

except as provided in clause (4).

(4)  A licensed psychologist may perform a utilization review

3

for behavioral health care services within the psychologist's

4

scope of practice if the psychologist's clinical experience

5

provides sufficient experience to review that specific

6

behavioral health care service. The use of a licensed

7

psychologist to perform a utilization review of a behavioral

8

health care service shall be approved by the Department of

9

Health as part of the certification process under section 2151.

10

A licensed psychologist shall not review the denial of payment

11

for a health care service involving inpatient care or a

12

prescription drug.

13

Section 1111.4  Grievances.--(a)  (1)  An issuer of a long-

14

term care insurance policy shall establish and maintain an

15

internal grievance process with two levels of review and an

16

expedited internal grievance process by which a policyholder,

17

certificate holder or a health care provider, with the written

18

consent of the policyholder or certificate holder, shall be able

19

to file a written grievance regarding the denial of payment for

20

a health care service. A policyholder or certificate holder who

21

consents to the filing of a grievance by a health care provider

22

under this section may not file a separate grievance.

23

(2)  The internal grievance process shall consist of an

24

initial review that includes all of the following:

25

(i)  A review by one or more persons selected by the long-

26

term care insurance policy issuer who did not previously

27

participate in the decision to deny payment for the health care

28

service.

29

(ii)  The completion of the review within thirty (30) days of

30

receipt of the grievance.

(iii)  A written notification to the policyholder or

2

certificate holder and health care provider regarding the

3

decision within five (5) business days of the decision. The

4

notice shall include the basis and clinical rationale for the

5

decision and the procedure to file a request for a second level

6

review of the decision.

7

(3)  The grievance process shall include a second level

8

review that includes all of the following:

9

(i)  A review of the decision issued pursuant to clause (2)

10

by a second level review committee consisting of three or more

11

persons who did not previously participate in any decision to

12

deny payment for the health care service.

13

(ii)  A written notification to the policyholder or

14

certificate holder or the health care provider of the right to

15

appear before the second level review committee.

16

(iii)  The completion of the second level review within

17

thirty (30) days of receipt of a request for such review.

18

(iv)  A written notification to the policyholder or

19

certificate holder and health care provider regarding the

20

decision of the second level review committee within five (5)

21

business days of the decision. The notice shall include the

22

basis and clinical rationale for the decision and the procedure

23

for appealing the decision.

24

(4)  Any initial review or second level review conducted

25

under this section shall include a licensed physician, or, where

26

appropriate, an approved licensed psychologist, in the same or

27

similar specialty that typically manages or consults on the

28

health care service.

29

(5)  Should the policyholder's or certificate holder's life,

30

health or ability to regain maximum function be in jeopardy, an

expedited internal grievance process shall be available, which

2

shall include a requirement that a decision with appropriate

3

notification to the policyholder or certificate holder and

4

health care provider be made within forty-eight (48) hours of

5

the filing of the expedited grievance.

6

(b)  (1)  An issuer of a long-term care insurance policy

7

shall establish and maintain an external grievance process by

8

which a policyholder, certificate holder or a health care

9

provider with the written consent of the policyholder or

10

certificate holder may appeal the denial of a grievance

11

following completion of the internal grievance process. The

12

external grievance process shall be conducted by an independent

13

utilization review entity not directly affiliated with the long-

14

term care insurance policy issuer.

15

(2)  To conduct external grievances filed under this section:

16

(i)  The Department of Health shall randomly assign a

17

utilization review entity on a rotational basis from the list

18

maintained under clause (4) and notify the assigned utilization

19

review entity and the long-term care insurance policy issuer

20

within two (2) business days of receiving the request. If the

21

Department of Health fails to select a utilization review entity

22

under this subsection, the long-term care insurance policy

23

issuer shall designate and notify a certified utilization review

24

entity to conduct the external grievance.

25

(ii)  The long-term care insurance policy issuer shall notify

26

the policyholder, certificate holder or health care provider of

27

the name, address and telephone number of the utilization review

28

entity assigned under this clause within two (2) business days.

29

(3)  The external grievance process shall meet all the

30

following requirements:

(i)  Any external grievance shall be filed with the long-term

2

care insurance policy issuer within fifteen (15) days of receipt

3

of a notice of denial resulting from the internal grievance

4

process. The filing of the external grievance shall include any

5

material justification and all reasonably necessary supporting

6

information. Within five (5) business days of the filing of an

7

external grievance, the long-term care insurance policy issuer

8

shall notify the policyholder, certificate holder or the health

9

care provider, the utilization review entity that conducted the

10

internal grievance and the Department of Health that an external

11

grievance has been filed.

12

(ii)  The utilization review entity that conducted the

13

internal grievance shall forward copies of all written

14

documentation regarding the denial, including the decision, all

15

reasonably necessary supporting information, a summary of

16

applicable issues and the basis and clinical rationale for the

17

decision to the utilization review entity conducting the

18

external grievance within fifteen (15) days of receipt of notice

19

that the external grievance was filed. Any additional written

20

information may be submitted by the policyholder, certificate

21

holder or the health care provider within fifteen (15) days of

22

receipt of notice that the external grievance was filed.

23

(iii)  The utilization review entity conducting the external

24

grievance shall review all information considered in reaching

25

any prior decisions to deny payment for the health care service

26

and any other written submission by the policyholder,

27

certificate holder or the health care provider.

28

(iv)  An external grievance decision shall be made by:

29

(A)  one or more licensed physicians or approved licensed

30

psychologists in active clinical practice or in the same or

similar specialty that typically manages or recommends treatment

2

for the health care service being reviewed; or

3

(B)  one or more physicians currently certified by a board

4

approved by the American Board of Medical Specialists or the

5

American Board of Osteopathic Specialties in the same or similar

6

specialty that typically manages or recommends treatment for the

7

health care service being reviewed.

8

(v)  Within sixty (60) days of the filing of the external

9

grievance, the utilization review entity conducting the external

10

grievance shall issue a written decision to the long-term care

11

insurance issuer, policyholder, certificate holder and the

12

health care provider, including the basis and clinical rationale

13

for the decision. The standard of review shall be whether the

14

health care service denied by the internal grievance process was

15

medically necessary and appropriate. The external grievance

16

decision shall be subject to appeal to a court of competent

17

jurisdiction within sixty (60) days of receipt of notice of the

18

external grievance decision. There shall be a rebuttable

19

presumption in favor of the decision of the utilization review

20

entity conducting the external grievance.

21

(vi)  The long-term care insurance policy issuer shall

22

authorize any health care service or pay a claim determined to

23

be medically necessary and appropriate under subclause (v)

24

pursuant to section 2166 whether or not an appeal to a court of

25

competent jurisdiction has been filed.

26

(vii)  All fees and costs related to an external grievance

27

shall be paid by the nonprevailing party if the external

28

grievance was filed by the health care provider. The health care

29

provider and the utilization review entity or long-term care

30

insurance policy issuer shall each place in escrow an amount

equal to one-half of the estimated costs of the external

2

grievance process. If the external grievance was filed by the

3

policyholder or certificate holder, all fees and costs related

4

thereto shall be paid by the long-term care insurance policy

5

issuer. For purposes of this clause, fees and costs shall not

6

include attorney fees.

7

(4)  The Department of Health shall compile and maintain a

8

list of certified utilization review entities that meet the

9

requirements of this article. The Department of Health may

10

remove a utilization review entity from the list if such an

11

entity is incapable of performing its responsibilities in a

12

reasonable manner, charges excessive fees or violates this

13

article.

14

(5)  A fee may be imposed by a long-term care insurance

15

policy issuer for filing an external grievance pursuant to this

16

article which shall not exceed twenty-five ($25) dollars.

17

(c)  Records regarding grievances filed under this article

18

that result in decisions adverse to policyholders or certificate

19

holders shall be maintained by the long-term care insurance

20

issuer for not less than three (3) years. These records shall be

21

provided to the Department of Health, if requested for purposes

22

of quality assurance, investigation of complaints or grievances,

23

enforcement or other activities related to compliance with this

24

article and other laws of this Commonwealth. Records shall be

25

accessible only to Department of Health employes or agents with

26

direct responsibilities under the provision of this subsection.

(d)  At any time throughout the grievance process in any

28

forum, the policyholder or certificate holder may be assisted or

29

represented by an attorney, Department of Aging long-term care

30

insurance ombudsman or representative, or other individual.

Section 1111.5  Prompt Processing and Payment of Claims.--(a)

2

Upon receipt of a claim for benefits, an insurer shall determine

3

whether it is complete. If it is not complete, within ten (10)

4

days of receipt thereof the insurer shall postmark to the

5

submitting person a statement of all items reasonably necessary

6

to be submitted to make the claim complete. Upon receipt of

7

those requested remaining items, the claim shall be complete and

8

all clean and uncontested portions thereof shall be paid within

9

thirty (30) days.

10

(b)  A long-term care insurance issuer shall pay a clean

11

claim submitted by a health care provider within forty-five (45)

12

days of receipt of the clean claim.

13

(c)  If a long-term care insurance issuer fails to remit the

14

payment as provided under subsection (a), interest at ten per

15

centum (10%) per annum shall be added to the amount owed on the

16

clean claim. Interest shall be calculated beginning the day

17

after the required payment date and ending on the date the claim

18

is paid. The long-term care insurance issuer shall not be

19

required to pay any interest calculated to be less than two ($2)

20

dollars.

21

(d)  (1)  In order to facilitate the prompt processing of

22

claims, each claim form processed or otherwise used by a long-

23

term care insurance issuer shall be the uniform claim form

24

developed by the department. Each form shall be identical,

25

except that the uniform claim form shall contain blank spaces at

26

appropriate places in the document for approved additional

27

information requests under clause (3).

28

(2)  The department shall forward the uniform claim form to

29

the Legislative Reference Bureau for publication as a notice in

30

the Pennsylvania Bulletin. A long-term care insurance issuer

shall be required to begin using the standard form as soon as

2

practicable following the publication but in no event later than

3

one hundred twenty (120) days following the publication.

4

(3)  A long-term care insurance issuer may request

5

departmental approval of additional information requests to be

6

printed in blank spaces on the uniform claim form, and on

7

subsequent pages if necessary, by submitting a written request

8

to the department. Such a request shall be deemed approved by

9

the department if not disapproved within sixty (60) days after

10

receipt of the request. A disapproval shall be subject to the

11

procedures under 2 Pa.C.S. (relating to administrative law and

12

procedure).

Section 4.  Section 1112 of the act, amended July 17, 2007

14

(P.L.134, No.40), is amended to read:

15

Section 1112.  Authority to Promulgate Regulations.--(a)  The

16

department shall promulgate reasonable regulations to establish

17

minimum standards for marketing practices, producer compensation

18

arrangements, producer testing, penalties and reporting

19

practices for long-term care insurance.

20

(b)  The department and the Department of Health may

21

promulgate reasonable regulations as may be necessary to carry

22

out the provisions of sections 1111.1, 1111.2, 1111.3 and

23

1111.4.

24

Section 5.  The act is amended by adding a section to read:

25

Section 1114.1  Annual Report.--Each long-term care insurance

26

issuer shall report annually to the commissioner on the form the

27

commissioner requires, a report that includes, but is not

28

limited to, the following information:

29

(1)  Information relating to adverse decisions, including:

30

(i)  The number of adverse decisions issued by the long-term

care insurance issuer under section 1111.1.

(ii)  The type of service at issue in the adverse decisions.

3

(2)  Information relating to complaints, including:

4

(i)  The number of complaints filed with the long-term care

5

insurance issuer.

6

(ii)  For each complaint filed with the long-term care

7

insurance issuer:

8

(A)  The outcome of the complaint.

9

(B)  Whether the complaint was resolved pursuant to the first

10

level internal review, second level internal review or before

11

the department or Department of Health.

12

(C)  The time within which the long-term care insurance

13

issuer resolved each complaint.

14

(3)  Information relating to grievances, including:

15

(i)  The number of grievances filed with the long-term care

16

insurance issuer.

17

(ii)  For each grievance filed with the long-term care

18

insurance issuer:

19

(A)  The outcome of the grievance.

20

(B)  Whether the grievance was resolved pursuant to the first

21

level internal review, second level internal review or external

22

grievance process.

23

(C)  Whether the grievance was subject to an expedited

24

review.

25

(D)  The time in which the long-term care insurance issuer

26

resolved each grievance.

27

(4)  Information relating to prompt payment of claims,

28

including:

29

(i)  The number of clean claims submitted by health care

30

providers not paid within forty-five (45) days of receipt of the

clean claim.

(ii)  The total amount of interest paid on claims not paid

3

within forty-five (45) days of receipt of the clean claim.

4

Section 6.  This act shall take effect in 60 days.
