AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for drug delivery

3

resulting in death.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 2506(a) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 2506.  Drug delivery resulting in death.

9

(a)  General rule.--A person commits [murder of the third

10

degree who] a felony of the first degree if the person

11

intentionally, knowingly or recklessly administers, dispenses,

12

delivers, gives, prescribes, sells or distributes any controlled

13

substance or counterfeit controlled substance in violation of

14

section 13(a)(14) or (30) of the act of April 14, 1972 (P.L.233,

No.64), known as The Controlled Substance, Drug, Device and

2

Cosmetic Act, and another person dies as a result of using the

3

substance.

Section 2.  This act shall take effect in 60 days.
