AN ACT

Amending the act of July 7, 2006 (P.L.390, No.83), entitled "An

act providing for the capital budget for the fiscal year

2005-2006; itemizing public improvement projects, furniture

and equipment projects, transportation assistance projects,

redevelopment assistance capital projects, flood control

projects, Keystone Recreation, Park and Conservation Fund

projects, Environmental Stewardship Fund projects, Motor

License Fund projects, State forestry bridge projects,

Pennsylvania Fish and Boat Commission projects, Manufacturing

Fund projects and federally funded projects to be constructed

or acquired or assisted by the Department of General

Services, the Department of Community and Economic

Development, the Department of Conservation and Natural

Resources, the Department of Environmental Protection, the

Pennsylvania Fish and Boat Commission, the Pennsylvania Game

Commission and the Department of Transportation, together

with their estimated financial costs; authorizing the

incurring of debt without the approval of the electors for

the purpose of financing the projects to be constructed,

acquired or assisted by the Department of General Services,

the Department of Community and Economic Development, the

Department of Conservation and Natural Resources, the

Department of Environmental Protection, the Department of

Transportation, the Pennsylvania Fish and Boat Commission or

the Pennsylvania Game Commission; stating the estimated

useful life of the projects; providing an exemption;

providing for limitation on certain capital projects and for

special provisions for certain redevelopment assistance

capital projects; and making appropriations," further

providing for Washington Crossing State Park in Bucks County.

The General Assembly of the Commonwealth of Pennsylvania

hereby enacts as follows:

Section 1.  Section 3(11)(ii)(A) of the act of July 7, 2006

(P.L.390, No.83), known as the Capital Budget Project

Itemization Act of 2005-2006, is amended to read:

Section 3.  Itemization of public improvement capital projects.

Additional capital projects in the category of public

improvement projects to be constructed or acquired by the

Department of General Services, its successors or assigns and to

be financed by the incurring of debt are hereby itemized,

together with their respective estimated financial costs, as

follows:

Section 2.  The act is amended by adding a section to read:

Section 18.1.  Special contract provisions for Pennsylvania

Historical and Museum project.

Notwithstanding the provisions of 62 Pa.C.S. (relating to

procurement) or any other law to the contrary, the Department of

General Services shall use the competitive sealed proposal

method of source selection to enter into a design/build contract

for the project which is authorized in section 3(11)(ii)(A) and

shall enter into a design/build contract for the project.

Section 3.  This act shall take effect in 60 days.
