AN ACT

Authorizing the Department of General Services, with the

2

approval of the Department of Military and Veterans Affairs

3

and the Governor, to grant and convey, at a price to be

4

determined through a competitive bid process, certain lands,

5

buildings and improvements situate in the City of Oil City,

6

Venango County; and authorizing the Department of General

7

Services, with the approval of the Department of Military and

8

Veterans Affairs and the Governor, to grant and convey, at a

9

price to be determined through a competitive bidding process,

10

certain lands, buildings and improvements situate in the

11

First Ward of the City of Meadville, Crawford County.

12

The General Assembly of the Commonwealth of Pennsylvania

13

hereby enacts as follows:

14

Section 1.  Conveyance in City of Oil City, Venango County.

15

(a)  Authorization.--The Department of General Services, with

16

the approval of the Department of Military and Veterans Affairs

17

and the Governor, to grant and convey, at a price to be

18

determined through a competitive bidding, the following tract of

19

land together with any buildings, structures or improvements

20

thereon, situate in the City of Oil City, Venango County,

21

Pennsylvania.

(b)  Property description.--The property to be conveyed

pursuant to subsection (a) consists of approximately 0.23-acres

2

and building, bounded and more particularly described as

3

follows:

4

ALL THAT CERTAIN tract of land situate in the Fifth Ward of

5

the City of Oil City, Venango County more particularly bounded

6

and described as follows:

7

BEGINNING at the Southeast corner of East Second Street and

8

State Street; thence Easterly along the Southerly side of East

9

Second Street, one hundred (100) feet; thence Southwardly at

10

right angles to said line of East Second Street, Ninety-nine and

11

ninety-two hundredths (99.92) feet to line of property conveyed

12

by Thomas M. Burk and wife to Edgar T. Eichner by deed dated

13

February 21, 1901, recorded in Deed Book Volume 253, Page 90;

14

thence Westwardly along said Eichner's line, one hundred (100)

15

feet to the Easterly line of State Street aforesaid; thence

16

Northwardly and along said line of State Street, Ninety-nine and

17

ninety-two hundredths (99.92) feet to corner of East Second

18

Street, the place of BEGINNING.

19

BEING Tax Parcel No. 16-006-206.

20

BEING the same premises conveyed from Ida R. Magee,

21

unmarried, to the Commonwealth of Pennsylvania, by deed dated

22

June 6, 1914 and recorded July 10, 1914, in the County of

23

Venango, Pennsylvania, in Deed Book 333, Page 185.

(c)  Conditions.--The conveyance shall be made under and

25

subject to all lawful and enforceable easements, servitudes and

26

rights of others, including but not confined to streets,

27

roadways and rights of any telephone, telegraph, water,

28

electric, gas or pipeline companies, as well as under and

29

subject to any lawful and enforceable estates or tenancies

30

vested in third persons appearing of record, for any portion of

the land or improvements erected thereon.

(d)  Restriction.--Any conveyance authorized under this

3

section shall be made under and subject to the condition, which

4

shall be contained in the deed of conveyance, that no portion of

5

the property conveyed shall be used as a licensed facility, as

6

defined in 4 Pa.C.S. § 1103 (relating to definitions), or any

7

other similar type of facility authorized under the laws of this

8

Commonwealth. The condition shall be a covenant running with the

9

land and shall be binding upon the grantee, and its successors.

Should the grantee, or its successors, permit any portion of the

11

property authorized to be conveyed in this section to be used in

12

violation of this subsection, the title shall immediately revert

13

to and revest in the grantor.

14

(e)  Deed.--The deed of conveyance shall be by Special

15

Warranty Deed and shall be executed by the Secretary of General

16

Services in the name of the Commonwealth of Pennsylvania.

17

(f)  Proceeds.--The proceeds from the sale shall be deposited

18

in the State Treasury Armory Fund.

Section 2.  Conveyance in City of Meadville, Crawford County.

20

(a)  Authorization.--The Department of General Services, with

21

the approval of the Department of Military and Veterans Affairs

22

and the Governor, is hereby authorized on behalf of the

23

Commonwealth of Pennsylvania to grant and convey the following

24

tract of land together with any buildings, structures or

25

improvements on the land, situate in the First Ward of the City

26

of Meadville, Crawford County. The Department of General

27

Services shall sell the property using, in its discretion,

28

either an invitation for sealed bids or a public auction.

29

(b)  Description.--The property to be conveyed pursuant to

30

subsection (a) consists of approximately 0.3297-acres and a

building bounded and more particularly described as follows:

ALL THAT CERTAIN tract of land situate in the First Ward of

3

the City of Meadville, County of Crawford, Pennsylvania, being

4

part of Lots Number One Hundred Five and One Hundred Six (#105

5

and #106) in the original plan of Meadville as laid out by David

6

Mead, more particularly bounded and described as follows:

7

BEGINNING, at the Northeast corner of Center Street and

8

Diamond Park; thence along the Westerly line of Diamond Park in

9

a Southerly direction a distance of ninety-three and five tenths

10

(93.5) feet to line of lot formerly of Mrs. Harriet D. McNulty,

11

now Rose G. Lippitt; thence in a Westerly direction by a line

12

parallel with Center Street, a distance of one hundred fifty

13

(150) feet to a point in said Lippitt's line; thence in a

14

Northerly direction by other lands of R. Bruce Gamble and E.

15

Lowry Humes and parallel with Diamond Park, a distance of

16

ninety-three and five tenths (93.5) feet to the Southerly line

17

of Center Street; thence by said line of Center Street in an

18

Easterly direction a distance of one hundred fifty (150) feet to

19

the corner of Center Street and Diamond Park, the place of

20

BEGINNING.

CONTAINING 0.3297-acres more or less.

BEING the same premises conveyed by R. Bruce Gamble and Nella

23

M. Gamble, his wife, and E. Lowry Humes and Mary E. Humes, his

24

wife, to the Commonwealth of Pennsylvania, by deed dated

25

February 7, 1912 and recorded in the Recorder's Office of

26

Crawford County, Pennsylvania, in Deed Book Volume 195, Page 11.

(c)  Conditions.--The conveyance shall be made under and

28
