The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the Recreational

7

Vehicle Lemon Law.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Dealer."  A person in the business of buying, selling,

13

leasing or exchanging recreational vehicles.

14

"Department."  The Department of Transportation of the

15

Commonwealth.

16

"Manufacturer."  Any person engaged in the business of

17

constructing or assembling new and unused recreational vehicles

18

or engaged in the business of importing new and unused

19

recreational vehicles into the United States for the purpose of

20

selling or distributing new and unused recreational vehicles to

21

dealers in this Commonwealth.

22

"Manufacturer's express warranty" or "warranty."  The written

23

warranty of the manufacturer of a new recreational vehicle of

24

its condition and fitness for use, including any terms or

25

conditions precedent to the enforcement of obligations under the

26

warranty.

27

"New recreational vehicle."  Any new and unused recreational

28

vehicle driven upon public roads, streets or highways, which was

29

purchased or leased and is registered in this Commonwealth or

30

purchased or leased elsewhere and registered for the first time

in this Commonwealth and is used, leased or bought for use

2

exclusively for personal, family or household purposes,

3

including a vehicle used by a manufacturer or dealer as a

4

demonstrator or dealer recreational vehicle prior to its sale.

5

"Nonconformity."  A defect or condition which substantially

6

impairs the use, value or safety of a new recreational vehicle

7

and does not conform to the manufacturer's express warranty.

8

"Purchaser."  A person, or a successor or assign of the

9

person, who obtains possession or ownership of a new

10

recreational vehicle by lease, transfer or purchase or who

11

enters into an agreement or contract for the lease or purchase

12

of a new recreational vehicle which is used, leased or bought

13

for use exclusively for personal, family or household purposes.

14

"Recreational vehicle."  A motor home, pickup truck with

15

attached camper or bus when used exclusively for personal

16

pleasure by individuals.

17

Section 3.  Disclosure.

18

(a)  Duty of Attorney General.--The Attorney General shall

19

prepare and publish in the Pennsylvania Bulletin a statement

20

which explains a purchaser's rights under this act.

21

(b)  Duty of manufacturers.--A manufacturer shall provide to

22

each purchaser at the time of original purchase of a new

23

recreational vehicle a written statement containing a copy of

24

the Attorney General's statement and a listing of zone offices,

25

with addresses and telephone numbers, that the purchaser may

26

contact regarding the remedies provided for in this act.

27

Section 4.  Repair obligations.

28

(a)  Repairs required.--The manufacturer of a new

29

recreational vehicle sold or leased and registered in this

30

Commonwealth shall repair or correct, at no cost to the

purchaser, a nonconformity which substantially impairs the use,

2

value or safety of the recreational vehicle which may occur

3

within a period of one year following the actual delivery of the

4

vehicle to the purchaser, within the first 12,000 miles of use

5

or during the term of the warranty, whichever may first occur.

6

(b)  Delivery of vehicle.--

7

(1)  A purchaser shall deliver a nonconforming vehicle to

8

the manufacturer's authorized service and repair facility

9

within this Commonwealth unless, due to reasons of size and

10

weight or method of attachment or method of installation or

11

nature of the nonconformity, delivery cannot reasonably be

12

accomplished.

13

(2)  (i)  Should the purchaser be unable to effect return

14

of the nonconforming vehicle, the purchaser shall notify

15

the manufacturer or its authorized service and repair

16

facility.

17

(ii)  Written notice of nonconformity to the

18

manufacturer or its authorized service and repair

19

facility shall constitute return of the vehicle when the

20

purchaser is unable to return the vehicle due to the

21

nonconformity.

22

(3)  Upon receipt of notice of nonconformity, the

23

manufacturer shall, at its option, service or repair the

24

vehicle at the location of nonconformity or pick up the

25

vehicle for service and repair or arrange for transporting

26

the vehicle to its authorized service and repair facility.

27

(4)  All costs of transporting the vehicle when the

28

purchaser is unable to effect return, due to nonconformity,

29

shall be at the manufacturer's expense.

Section 5.  Manufacturer's duty for refund or replacement.

(a)  General rule.--If a manufacturer fails to repair or

2

correct a nonconformity after a reasonable number of attempts,

3

the manufacturer shall, at the option of the purchaser, replace

4

the recreational vehicle with a comparable recreational vehicle

5

of equal value or accept return of the vehicle from the

6

purchaser and refund to the purchaser the full purchase price or

7

lease price, including all collateral charges, less a reasonable

8

allowance for the purchaser's use of the vehicle not exceeding

9

10¢ per mile driven or 10% of the purchase price or lease price

10

of the vehicle, whichever is less. Refunds shall be made to the

11

purchaser and lienholder, if any, as their interests may appear.

12

A reasonable allowance for use shall be that amount directly

13

attributable to use by the purchaser prior to the first report

14

of the nonconformity to the manufacturer.

15

(b)  Time for making refund.--In the event the consumer

16

elects a refund, payment shall be made within 30 days of such

17

election.

18

(c)  Conditions precluding refund.--A consumer shall not be

19

entitled to a refund or replacement if the nonconformity does

20

not substantially impair the use, value or safety of the vehicle

21

or the nonconformity is the result of abuse, neglect or

22

modification or alteration of the recreational vehicle by the

23

purchaser.

24

Section 6.  Presumption of reasonable number of attempts.

25

It shall be presumed that a reasonable number of attempts

26

have been undertaken to repair or correct a nonconformity if:

27

(1)  the same nonconformity has been subject to repair

28

three times by the manufacturer, its agents or authorized

29

dealers and the nonconformity still exists; or

30

(2)  the recreational vehicle is out of service by reason

of any nonconformity for a cumulative total of 30 or more

2

calendar days.

Section 7.  Itemized statement required.

4

(a)  General rule.--A manufacturer or dealer shall provide to

5

the purchaser each time the purchaser's vehicle is returned from

6

being serviced or repaired a fully itemized statement indicating

7

all work performed on the recreational vehicle, including, but

8

not limited to, parts and labor.

9

(b)  Dealer duty to notify manufacturer.--A dealer shall

10

notify the manufacturer of the existence of a nonconformity

11

within seven days of the delivery by a purchaser of a vehicle

12

subject to a nonconformity when it is delivered to the same

13

dealer for the second time for repair of the same nonconformity.

14

The notification shall be by certified mail, return receipt

15

requested.

16

Section 8.  Civil cause of action.

17

The purchaser of a new recreational vehicle who suffers any

18

loss due to nonconformity of the vehicle as a result of the

19

manufacturer's failure to comply with this act may bring a civil

20

action in a court of common pleas and, in addition to other

21

relief, shall be entitled to recover reasonable attorney fees

22

and all court costs.

23

Section 9.  Informal dispute settlement procedure.

24

If the manufacturer has established an informal dispute

25

settlement procedure which complies with 16 CFR Pt. 703

26

(relating to informal dispute settlement procedures), section 8

27

shall not apply to any purchaser who has not first resorted to

28

such procedure as it relates to a remedy for defects or

29

conditions affecting the substantial use, value or safety of the

30

vehicle. The informal dispute settlement procedure shall not be

binding on the purchaser, and, in lieu of such settlement, the

2

purchaser may pursue a remedy under section 8.

Section 10.  Resale of returned recreational vehicle.

4

(a)  Prohibition.--If a recreational vehicle has been

5

repurchased under this act or a similar statute of another

6

state, it may not be resold, transferred or leased in this

7

Commonwealth unless:

8

(1)  The manufacturer provides the same express warranty

9

it provided to the original purchaser, except that the term

10

of the warranty need only last for 12,000 miles or 12 months

11

after the date of resale, transfer or lease, whichever is

12

earlier.

13

(2)  The manufacturer provides the purchaser, lessee or

14

transferee with a written statement on a separate piece of

15

paper, in ten-point all capital type, in substantially the

16

following form:

17

IMPORTANT: THIS VEHICLE WAS REPURCHASED BY THE

18

MANUFACTURER BECAUSE IT DID NOT CONFORM TO THE

19

MANUFACTURER'S EXPRESS WARRANTY, AND THE NONCONFORMITY

20

WAS NOT CURED WITHIN A REASONABLE TIME AS PROVIDED BY

21

PENNSYLVANIA LAW.

22

(3)  The dealer, lessor or transferor clearly and

23

conspicuously discloses the manufacturer's written

24

notification prior to the resale or lease of the repurchased

25

vehicle.

26

(4)  The dealer, lessor or transferor obtains a signed

27

receipt certifying in a conspicuous and understandable manner

28

that the written statement required under this subsection has

29

been provided. Access to the receipt shall be maintained for

30

four years. The Attorney General shall approve the form and

content of the disclosure statement supplied by the

2

manufacturer.

(5)  The manufacturer, dealer, lessor or transferor

4

applies for and receives the designation of a branded title

5

from the department.

6

(6)  The department updates its records and issues a

7

title with a designation indicating that the vehicle was

8

repurchased under this act. The department shall forward to

9

subsequent purchasers or lienholders, in accordance with 75

10

Pa.C.S. §§ 1107 (relating to delivery of certificate of

11

title) and 1132.1 (relating to perfection of a security

12

interest in a vehicle), a certificate of title which

13

indicates that the vehicle was branded under this act. The

14

department shall determine the exact form and content of the

15

title brand.

16

(b)  Applicability and penalty.--

17

(1)  This section applies to the resold, transferred or

18

leased vehicle for the full term of the warranty required

19

under this subsection.

20

(2)  Failure of the manufacturer, dealer, lessor or

21

transferor to notify its immediate purchaser of the

22

requirements of this section subjects the manufacturer,

23

dealer, lessor or transferor to pay to the Commonwealth a

24

civil penalty of $2,000 per violation and, at the option of

25

the purchaser, to replace the vehicle with a comparable

26

vehicle of equal value or accept return of the vehicle from

27

the purchaser and refund to the purchaser the full purchase

28

price, including all collateral charges, less a reasonable

29

allowance for the purchaser's use of the vehicle not

30

exceeding 10¢ per mile driven or 10% of the purchase price of

the vehicle, whichever is less.

(c)  Returned vehicles not to be resold.--Notwithstanding the

3

provisions of subsection (a), if a new recreational vehicle has

4

been returned under this act or a similar statute of another

5

state because of a nonconformity resulting in a complete failure

6

of the braking or steering system of the vehicle likely to cause

7

death or serious bodily injury if the vehicle was driven, the

8

vehicle may not be resold in this Commonwealth.

9

(d)  Agreement waiving, limiting or disclaiming rights.--An

10

agreement entered into by a purchaser that waives, limits or

11

disclaims the rights set forth in this act is void as contrary

12

to public policy. Where applicable, the rights set forth in this

13

act shall extend to a subsequent purchaser, lessee or transferee

14

of the recreational vehicle.

15

Section 11.  Application of unfair trade act.

16

A violation of this act is a violation of the act of December

17

17, 1968 (P.L.1224, No.387), known as the Unfair Trade Practices

18

and Consumer Protection Law.

19

Section 12.  Construction.

20

Nothing in this act shall be construed to limit the purchaser

21

from pursuing any other rights or remedies under any other law,

22

contract or warranty.

23

Section 13.  Nonwaiver of act.

24

The provisions of this act may not be waived.

25

Section 14.  Applicability.

26

This act shall apply to new recreational vehicles purchased

27

after the effective date of this section.

28

Section 15.  Effective date.

29

This act shall take effect in 60 days.
