| AN ACT |
| |
1 | Amending Title 62 (Procurement) of the Pennsylvania Consolidated |
2 | Statutes, providing for construction safety and health |
3 | training. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 62 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 3914. Construction safety and health training. |
9 | All contracts entered into by a government agency in excess |
10 | of $250,000 shall contain a clause requiring all laborers, |
11 | workers and mechanics employed in the performance of the |
12 | contract on the public work site, by the contractor, |
13 | subcontractor or other person doing or contracting to do the |
14 | whole or a part of the work contemplated by the contract, to be |
15 | certified prior to performing any work on the project as having |
16 | successfully completed a course in construction safety and |
17 | health approved by the United States Department of Labor's |
18 | Occupational Safety and Health Administration that is at least |

1 | ten hours in duration. Proof of certification by all laborers, |
2 | workers and mechanics employed by the contractor, subcontractor |
3 | or other person doing or contracting to do the whole or a part |
4 | of the work contemplated by the contract shall be submitted to |
5 | the department by the contractor, subcontractor or other person |
6 | doing or contracting to do the whole or a part of the work |
7 | contemplated by the contract and kept on file. |
8 | Section 2. This act shall take effect in 60 days. |
