AN ACT

Amending Title 62 (Procurement) of the Pennsylvania Consolidated

2

Statutes, providing for construction safety and health

3

training.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 62 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 3914.  Construction safety and health training.

9

All contracts entered into by a government agency in excess

10

of $250,000 shall contain a clause requiring all laborers,

11

workers and mechanics employed in the performance of the

12

contract on the public work site, by the contractor,

13

subcontractor or other person doing or contracting to do the

14

whole or a part of the work contemplated by the contract, to be

15

certified prior to performing any work on the project as having

16

successfully completed a course in construction safety and

17

health approved by the United States Department of Labor's

18

Occupational Safety and Health Administration that is at least

ten hours in duration. Proof of certification by all laborers,

2

workers and mechanics employed by the contractor, subcontractor

3

or other person doing or contracting to do the whole or a part

4

of the work contemplated by the contract shall be submitted to

5

the department by the contractor, subcontractor or other person

6

doing or contracting to do the whole or a part of the work

7

contemplated by the contract and kept on file.

8

Section 2.  This act shall take effect in 60 days.
