AN ACT

Amending the act of January 25, 1966 (1965 P.L.1546, No.541),

2

entitled "An act providing scholarships and providing funds

3

to secure Federal funds for qualified students of the

4

Commonwealth of Pennsylvania who need financial assistance to

5

attend postsecondary institutions of higher learning, making

6

an appropriation, and providing for the administration of

7

this act," authorizing the Nursing Undergraduate Returning

8

Student Eligibility Program.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

11

Section 1.  The act of January 25, 1966 (1965 P.L.1546, No.

12

541), referred to as the Higher Education Scholarship Law, is

13

amended by adding a section to read:

14

Section 8.5.  Nursing Undergraduate Returning Student

15

Eligibility Program.--(a)  The Nursing Undergraduate Returning

16

Student Eligibility Program is established in the agency.

17

Beginning in the 2009-2010 fiscal year and each year thereafter,

18

to the extent that funds are specifically appropriated for the

purpose, the agency shall provide up to four additional years of

2

grant eligibility for applicants who previously completed an

3

undergraduate degree program and enroll in an agency-approved

4

nursing program at an approved institution of higher learning

5

within this Commonwealth.

6

(b)  As part of its annual budget request to the General

7

Assembly, the agency shall request funds for the purpose of

8

carrying out the provisions of this section separate from the

9

agency's request for funds under section 8 of this act.

10

(c)  The scholarship shall be terminated if the student

11

receives his degree in a shorter period of time. Qualifications

12

for renewal shall include maintaining satisfactory academic

13

standing, making normal progress toward completion of the course

14

of study and continued eligibility as determined by the agency,

15

including continual legal residency.

16

(d)  The agency shall determine eligibility criteria and

17

approve programs, including, but not limited to, nurse education

18

programs and nurse instructor programs at approved institutions

19

of higher learning within this Commonwealth.

20

(e)  A grant recipient shall enter into a contract with the

21

agency that requires the recipient, upon successful completion

22

of an approved nursing program and licensure as a registered

23

nurse to practice nursing in this Commonwealth or a nursing

24

instructor program, to practice or teach for a period of not

25

less than five consecutive years.

26

(f)  The contract entered into with the agency pursuant to

27

subsection (e) of this section shall be considered a contract

28

with the Commonwealth and shall include the following terms:

29

(1)  For nurse education program participants:

30

(i)  An unlicensed recipient shall apply for a registered

nurse's license to practice in this Commonwealth at the earliest

2

practicable opportunity upon successfully completing a degree in

3

nursing.

4

(ii)  Within six months after licensure, a recipient shall

5

engage in the practice of nursing in this Commonwealth according

6

to the terms of the grant award.

7

(iii)  The recipient shall agree to practice in a licensed

8

health care facility in the provision of direct patient care on

9

a full-time basis.

10

(iv)  The recipient shall permit the agency to determine

11

compliance with the work requirements for nurses and all other

12

terms of the contract.

13

(v)  Upon the recipient's death or total or permanent

14

disability, the agency shall nullify the service obligation of

15

the recipient.

16

(vi)  If the recipient is convicted of or pleads guilty or no

17

contest to a felony or if the licensing board has determined

18

that the recipient has committed an act of gross negligence in

19

the performance of service obligations or has suspended or

20

revoked the license to practice, the agency shall terminate the

21

recipient's service in the program and demand repayment of the

22

amount of grants as of the date of the conviction,

23

determination, suspension or revocation.

24

(vii)  Recipients who fail to begin or complete the

25

obligations contracted for shall pay to the agency the amount of

26

the grants received under the terms of the contract pursuant to

27

this section. Providing false information or misrepresentation

28

on an application or verification of service shall be deemed a

29

default.

(2)  For nurse instructor program participants:

(i)  Within six months after completion of a nurse instructor

2

program, a recipient shall engage in the practice of instructing

3

nurses in this Commonwealth, according to the terms of the grant

4

award.

5

(ii)  The recipient shall agree to teach at an approved

6

institution of higher learning in this Commonwealth.

7

(iii)  The recipient shall permit the agency to determine

8

compliance with the work requirement for nurse instructors and

9

all other terms of the contract.

10

(iv)  Upon the recipient's death or total or permanent

11

disability, the agency shall nullify the service obligation of

12

the recipient.

13

(v)  Grant recipients who fail to begin or complete the

14

obligations contracted for shall pay to the agency the amount of

15

the grants received under the terms of the contract pursuant to

16

this section. Providing false information or misrepresentation

17

on an application or verification of service shall be deemed a

18

default.

19

(g)  The agency shall convert to loans the grants awarded to

20

participants who fail to complete the five-year employment

21

requirement, which loans must be repaid in accordance with

22

repayment terms established by the agency.

23

(h)  Payments received by the agency under subsection (f) of

24

this section shall be used to provide additional grants under

25

the program.

26

Section 2.  This act shall take effect in 60 days.
