| AN ACT |
| |
1 | Amending the act of December 17, 1968 (P.L.1224, No.387), |
2 | entitled "An act prohibiting unfair methods of competition |
3 | and unfair or deceptive acts or practices in the conduct of |
4 | any trade or commerce, giving the Attorney General and |
5 | District Attorneys certain powers and duties and providing |
6 | penalties," providing for the definitions of "motor fuel" and |
7 | "retail dealer" and setting limitations on raising the price |
8 | of motor fuel. |
9 | The General Assembly of the Commonwealth of Pennsylvania |
10 | hereby enacts as follows: |
11 | Section 1. Section 2 of the act of December 17, 1968 (P.L. |
12 | 1224, No.387), known as the Unfair Trade Practices and Consumer |
13 | Protection Law, reenacted and amended November 24, 1976 (P.L. |
14 | 1166, No.260), is amended by adding clauses to read: |
15 | Section 2. Definitions.--As used in this act. |

17 | (1.2) "Motor fuel" means a fuel, liquid fuel or alternative |
18 | fuel as those terms are defined in 75 Pa.C.S. § 9002 (relating |
19 | to definitions). |

1 | (2.1) "Retail dealer" means a person operating a service |
2 | station, filling station, store, garage or other place of |
3 | business selling motor fuel for delivery into the service tank |
4 | or tanks of a vehicle propelled by an internal combustion |
5 | engine. |

7 | Section 2. The act is amended by adding a section to read: |
8 | Section 9.4. Limitation on Raising Motor Fuel Prices.--No |
9 | retail dealer may sell motor fuel at a price, including tax, |
10 | greater than the price posted, and the price posted shall remain |
11 | in effect for a period of not less than twenty-four consecutive |
12 | hours. |
13 | Section 3. This act shall take effect immediately. |
