AN ACT

Amending Title 51 (Military Affairs) of the Pennsylvania

2

Consolidated Statutes, establishing a Decoration of Veterans'

3

Graves Fund.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 51 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 3706.  Decoration of Veterans' Graves Fund.

9

(a)  Establishment of fund.--There is established in the

10

State Treasury a restricted receipts account within the General

11

Fund which shall be known as the Decoration of Veterans' Graves

12

Fund.

13

(b)  Purpose.--All contributions received for the benefit of

14

the fund shall be used by the department to procure suitable

veterans' grave markers and United States flags to be

2

distributed to participating counties for the perpetual

3

decoration of veterans' graves. The equitable distribution of

4

suitable veterans' grave markers and flags shall be determined

5

by the department based on application information submitted

6

annually by participating counties.

(c)  Administration of program.--

8

(1)  The department shall accept voluntary contributions

9

from persons for deposit into the fund.

10

(2)  All moneys received shall be deposited into the

11

fund.

12

(d)  Use of fund.--The moneys deposited in the fund shall be

13

distributed on a continuing basis for the procurement of markers

14

and flags for veterans' graves.

15

(e)  Reporting.--Not later than July 31, 2011, and July 31

16

each year thereafter for the length of the program, the

17

department shall submit a status report on the Decoration of

18

Veterans' Graves Fund program to include all moneys in the fund

19

and distribution of the flags and veterans' markers to the

20

participating counties, to the Veterans Affairs and Emergency

21

Preparedness Committee of the Senate and to the Veterans Affairs

22

and Emergency Preparedness Committee of the House of

23

Representatives.

(f)  Guidelines.--The department shall develop guidelines for

25

the administration of this section.

Section 2.  This act shall take effect July 1, 2009.
