AN ACT

Amending Title 53 (Municipalities Generally) of the Pennsylvania

2

Consolidated Statutes, further providing for definitions and

3

for powers and duties of commission; and providing for in-

4

service training for police officers.

5

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 2162 of Title 53 of the Pennsylvania

8

Consolidated Statutes is amended by adding a definition to read:

9

§ 2162.  Definitions.

10

The following words and phrases when used in this subchapter

11

shall have the meanings given to them in this section unless the

12

context clearly indicates otherwise:

"Distance education."  Education in which the police officer

15

participates in educational activity by use of a computer rather

16

than a classroom where the faculty and police officer are

17

physically located in the same room.

Section 2.  Section 2164(6) of Title 53 is amended to read:

§ 2164.  Powers and duties of commission.

3

The powers and duties of the commission shall be as follows:

(6)  To require every police officer to attend a minimum

6

number of hours of in-service training as provided [for by

7

regulation] in section 2169.1 (relating to in-service

8

training for police officers), unless the officer's employer

9

files a show cause document with the commission requesting

10

additional time for the officer to comply with the in-service

11

training requirements. Approval of this request shall be made

12

by the commission on a case-by-case basis.

Section 3.  Title 53 is amended by adding a section to read:

15

§ 2169.1.  In-service training for police officers.

16

(a)  General rule.--The following shall apply to police

17

officers:

18

(1)  Police officers shall complete 24 hours of in-

19

service training biennially.

20

(2)  Police officers shall be permitted to complete up to

21

one-half of the biennial requirement of in-service training

22

through distance education.

23

(3)  Police officers may submit proof of successful

24

completion of academic courses taken from an accredited

25

college or university in order to fulfill a portion of the

26

biennial requirement of in-service training.

27

(b)  Duties of commission.--The commission shall promulgate

28

reasonable regulations to implement a system of in-service

29

training for police officers:

(1)  Requiring police officers to complete 24 hours of

in-service training biennially.

(2)  Permitting police officers to complete up to one-

3

half of the biennial requirement of in-service training

4

through distance education. The commission shall approve

5

course providers and course content.

(3)  Permitting police officers to submit proof of

7

successful completion of academic courses taken from an

8

accredited college or university in order to fulfill a

9

portion of the biennial requirement of in-service training.

The commission shall:

11

(i)  Determine the number of hours which may be

12

approved for fulfilling the biennial in-service

13

requirement through the successful completion of academic

14

courses.

15

(ii)  Approve course providers and course content.

16

(4)  Permitting the calculation of hours of in-service

17

training through the use of continuing education units as

18

appropriate in the case of a police officer who fulfills the

19

biennial requirement of in-service training through distance

20

education and successful completion of academic courses taken

21

from an accredited college or university.

22

Section 4.  This act shall take effect in 60 days.
