                                     AN ACT

     1  Making an appropriation to the Department of Environmental
     2     Protection for the rebate program for hybrid vehicles.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Hybrid
     7  Vehicle Rebate Program Funding Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Environmental Protection of
    13  the Commonwealth.
    14     "Fund."  The Alternative Fuels Incentive Fund.
    15  Section 3.  Appropriation; disbursement.
    16     (a)  Appropriation.--The sum of $15,000,000 shall be
    17  appropriated to the fund from the proceeds of any bonds issued

     1  by enactment of legislation for alternative energy and other
     2  energy-related projects.
     3     (b)  Disbursement.--
     4         (1)  The department shall annually disburse $3,000,000 of
     5     the appropriation under subsection (a) for the purpose of the
     6     rebate program established under section 3(d) of the act of
     7     November 29, 2004 (P.L.1376, No.178), known as the
     8     Alternative Fuels Incentive Act.
     9         (2)  The funds dedicated to the rebate program under this
    10     section shall be in addition to any funds allocated to the
    11     rebate program under the Alternative Fuels Incentive Act.
    12         (3)  Notwithstanding section 3(d)(1) of the Alternative
    13     Fuels Incentive Act, rebates for the purchase of hybrid
    14     vehicles under the Alternative Fuels Incentive Act shall be
    15     $750 per applicant, to the extent that funding is available.
    16     (c)  Continuing appropriation.--Unused funds from the
    17  appropriation under subsection (a) and funds remaining in the
    18  fund shall not lapse into the General Fund at the end of the
    19  fiscal year.
    20  Section 4.  Notice.
    21     The department shall forward notice of statutory
    22  authorization to issue bonds for alternative energy and other
    23  energy-related projects to the Legislative Reference Bureau for
    24  publication in the Pennsylvania Bulletin.
    25  Section 20.  Effective date.
    26     This act shall take effect as follows:
    27         (1)  The following provisions shall take effect
    28     immediately:
    29             (i)  Section 4.
    30             (ii)  This section.

     1         (2)  The remainder of this act shall take effect on the
     2     later of:
     3             (i)  the date of publication of the notice under
     4         section 4; or
     5             (ii)  60 days.
