                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.343, No.176), entitled,
     2     as amended, "An act relating to the finances of the State
     3     government; providing for the settlement, assessment,
     4     collection, and lien of taxes, bonus, and all other accounts
     5     due the Commonwealth, the collection and recovery of fees and
     6     other money or property due or belonging to the Commonwealth,
     7     or any agency thereof, including escheated property and the
     8     proceeds of its sale, the custody and disbursement or other
     9     disposition of funds and securities belonging to or in the
    10     possession of the Commonwealth, and the settlement of claims
    11     against the Commonwealth, the resettlement of accounts and
    12     appeals to the courts, refunds of moneys erroneously paid to
    13     the Commonwealth, auditing the accounts of the Commonwealth
    14     and all agencies thereof, of all public officers collecting
    15     moneys payable to the Commonwealth, or any agency thereof,
    16     and all receipts of appropriations from the Commonwealth,
    17     authorizing the Commonwealth to issue tax anticipation notes
    18     to defray current expenses, implementing the provisions of
    19     section 7(a) of Article VIII of the Constitution of
    20     Pennsylvania authorizing and restricting the incurring of
    21     certain debt and imposing penalties; affecting every
    22     department, board, commission, and officer of the State
    23     government, every political subdivision of the State, and
    24     certain officers of such subdivisions, every person,
    25     association, and corporation required to pay, assess, or
    26     collect taxes, or to make returns or reports under the laws
    27     imposing taxes for State purposes, or to pay license fees or
    28     other moneys to the Commonwealth, or any agency thereof,
    29     every State depository and every debtor or creditor of the
    30     Commonwealth," further providing for State-owned vehicle use.

    31     The General Assembly of the Commonwealth of Pennsylvania


     1  hereby enacts as follows:
     2     Section 1.  The act of April 9, 1929 (P.L.343, No.176), known
     3  as The Fiscal Code, is amended by adding an article to read:
     4                            ARTICLE XV-B
     5                      STATE-OWNED VEHICLE USE
     6  Section 1501-B.  Definitions.
     7     The following words and phrases when used in this article
     8  shall have the meanings given to them in this section unless the
     9  context clearly indicates otherwise:
    10     "Department."  The Department of General Services of the
    11  Commonwealth.
    12     "Official business."  Work performed on behalf of the
    13  Commonwealth as part of a State employee's job duties and
    14  responsibilities. The term does not include travel between a
    15  State employee's home and the employee's primary workplace.
    16  Section 1502-B.  Assignment of vehicle.
    17     No State employee shall be eligible for a long-term
    18  assignment of a State-owned vehicle unless the employee's duties
    19  require the employee to travel at least 1,200 miles per month on
    20  official business.
    21  Section 1503-B.  Mileage log.
    22     Any State employee who is assigned a State-owned vehicle
    23  shall be required to maintain a monthly mileage log detailing
    24  the employee's use of the vehicle.
    25  Section 1504-B.  Log maintenance.
    26     The department shall post and maintain these logs on its
    27  website in such a manner that they can be searched, at a
    28  minimum, by department, the employee's full name, vehicle make
    29  and vehicle model.
    30  Section 1505-B.  Redaction.

     1     Logs maintained by law enforcement personnel may be redacted
     2  to the extent that redaction is necessary to protect the
     3  following:
     4         (1)  The integrity of an ongoing criminal investigation.
     5         (2)  The identity of an employee who performs undercover
     6     law enforcement duties.
     7  Section 1506-B.  Reimbursement.
     8     Any State employee who is assigned a State-owned vehicle
     9  shall reimburse the State a reasonable amount, proportional to
    10  the employee's use of the vehicle for personal business, for
    11  State-provided insurance coverage and the cost of gasoline.
    12  Section 1507-B.  Official use license plate.
    13     Any State-owned vehicle assigned to an employee shall have an
    14  official use license plate unless the employee to which that
    15  State-owned vehicle is assigned performs undercover law
    16  enforcement duties.
    17  Section 1508-B.  Applicability.
    18     This act shall not apply to elected public officials.
    19     Section 2.  This act shall take effect in 60 days.
