        INTRODUCED BY TOMLINSON, BOSCOLA, PILEGGI, CORMAN, LAVALLE,
           ERICKSON, GREENLEAF, KASUNIC, WOZNIAK, RHOADES, STOUT,
           KITCHEN, STACK AND WASHINGTON, MAY 22, 2008

        SENATOR TOMLINSON, CONSUMER PROTECTION AND PROFESSIONAL
           LICENSURE, AS AMENDED, JUNE 3, 2008

                                     AN ACT

     1  Amending the act of December 22, 1983 (P.L.306, No.84), entitled
     2     "An act providing for the State Board of Vehicle
     3     Manufacturers, Dealers and Salespersons; and providing
     4     penalties," providing for licensing cost.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of December 22, 1983 (P.L.306, No.84),
     8  known as the Board of Vehicles Act, is amended by adding a
     9  section to read:
    10  Section 27.1  Licensing cost.
    11     (a)  Licensing cost.--Subject to the limitations established
    12  under subsection (c), a licensed dealer who has a contract with
    13  the Department of Transportation pursuant to 75 Pa.C.S. §
    14  1331(f)(6) (relating to issuance and reissuance of registration
    15  plates) may charge the purchaser of a vehicle a licensing cost
    16  authorized PERMISSIBLE under 75 Pa.C.S. Ch. 19 (relating to       <--
    17  fees) AND THE ACT OF DECEMBER 17, 1968 (P.L.1224, NO.387), KNOWN  <--
    18  AS THE UNFAIR TRADE PRACTICES AND CONSUMER PROTECTION LAW AND

     1  REGULATIONS PROMULGATED THEREUNDER, to include any of the
     2  following:
     3         (1)  The actual cost incurred by the dealer for fees
     4     associated with titling and registering the vehicle,
     5     including messenger fees, notary fees and electronic
     6     transaction fees.
     7         (2)  A documentary preparation fee CHARGE for:             <--
     8             (i)  Preparation and completion of documents required
     9         TO REGISTER AND LICENSE THE VEHICLE under 75 Pa.C.S.       <--
    10         (relating to vehicles).
    11             (ii)  Collection and submission of taxes payable by
    12         the purchaser.
    13             (iii)  Preparation of any other information
    14         associated with titling and registration of a vehicle.
    15     (b)  Out-of-State title.--The provisions of subsection (a)
    16  shall apply whether or not the purchaser intends to title and
    17  register the vehicle outside this Commonwealth.
    18     (c)  Limitations.--The following limitations shall apply:
    19         (1)  A dealer which provides electronic transaction
    20     services for documents under subsection (a)(2) may impose a
    21     maximum charge of $120. $100 FOR CALENDAR YEAR 2008 AND A      <--
    22     MAXIMUM CHARGE OF $120 FOR CALENDAR YEAR 2009.
    23         (2)  A dealer which does not provide electronic
    24     transaction services for document preparation under
    25     subsection (a)(2) may impose a maximum charge of $100. $80     <--
    26     FOR CALENDAR YEAR 2008 AND A MAXIMUM CHARGE OF $100 FOR
    27     CALENDAR YEAR 2009.
    28     (d)  Adjustment.--Beginning in January 2010, and annually
    29  thereafter, the licensing cost for documentary preparation shall
    30  be adjusted in accordance with the Federal Consumer Price Index

     1  for All Urban Consumers (CPI-U) for all items as published by
     2  the United States Department of Labor, Bureau of Labor
     3  Statistics, for the previous 12-month period on a cumulative
     4  basis. Any adjustment which is less than 50¢ shall be rounded
     5  down to the next lowest dollar amount and any adjustment which
     6  is 50¢ or greater shall be rounded up to the next highest dollar
     7  amount.
     8     (e)  Fees.--Licensing costs under this section shall not be
     9  considered fees for purposes of section 30 or 31.
    10     Section 2.  This act shall take effect immediately.
