        INTRODUCED BY VANCE, COSTA, D. WHITE, O'PAKE, RAFFERTY, EARLL,
           BAKER, BOSCOLA, BROWNE, FONTANA, GORDNER, GREENLEAF, LOGAN,
           MUSTO, ORIE, PIPPY, ROBBINS, TOMLINSON, WASHINGTON AND
           WONDERLING, MARCH 14, 2008

        REFERRED TO EDUCATION, MARCH 14, 2008

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for State
     6     reimbursement for health services.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2505.1(a) of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended July 13, 1979 (P.L.94, No.41), is amended to read:
    12     Section 2505.1.  State Reimbursement for Health Services.--
    13  (a)  Every school district and joint school board which renders
    14  health services to children of school age shall be reimbursed by
    15  the Commonwealth on account of health services which conform to
    16  standards approved by the Secretary of Health. Reimbursements
    17  shall be paid by the Secretary of Health. The amount thereof
    18  shall be the actual cost of the medical and dental services and
    19  school nurse services as certified to the Secretary of Health,

     1  less any charges deemed unreasonable by him, but for medical
     2  services shall not for any school year exceed the sum of (1) one
     3  dollar and sixty cents ($1.60) multiplied by the number of
     4  children enrolled in a school for the entire school term of that
     5  school year and for whom the school district or joint school
     6  board maintains comprehensive health records as defined in
     7  section 1402, and (2) a proportionate part of one dollar and
     8  sixty cents ($1.60) for each child enrolled for a part of the
     9  school term of that school year and for whom the school district
    10  or joint school board maintains a comprehensive health record as
    11  defined in section 1402, for dental services shall not for any
    12  school year exceed the sum of (1) eighty cents ($.80) multiplied
    13  by the number of children enrolled in a school for the entire
    14  school term of that school year and for whom the school district
    15  or joint school board maintains comprehensive health records as
    16  defined in section 1402, and (2) a proportionate part of eighty
    17  cents ($.80) for each child enrolled for a part of the school
    18  term of that school year and for whom the school district or
    19  joint school board maintains a comprehensive health record as
    20  defined in section 1402, and for school nurse services shall not
    21  for any school year exceed the sum of (1) [seven dollars
    22  ($7.00)] twelve dollars ($12.00) multiplied by the number of
    23  children enrolled in a school for the entire school term of that
    24  school year, and (2) a proportionate part of [seven dollars
    25  ($7.00)] twelve dollars ($12.00) for each child enrolled for a
    26  part of the school term of that school year.
