AN ACT
1 Providing for reports relating to disciplinary action taken by
2 State-owned institutions, State-related institutions and
3 community colleges.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Short title.
7 This act shall be known and may be cited as the College
8 Disciplinary Action Report Act.
9 Section 2. Definitions.
10 The following words and phrases when used in this act shall
11 have the meanings given to them in this section unless the
12 context clearly indicates otherwise:
13 "Community college." An institution created under Article
14 XIX-A of the act of March 10, 1949 (P.L.30, No.14), known as the
15 Public School Code of 1949, or the former act of August 24, 1963
16 (P.L.1132, No.484), known as the Community College Act of 1963.
17 "Educational institution." A State-owned institution, State-
18 related institution or community college located in this
1 Commonwealth.
2 "Host community." The borough, city, incorporated town or
3 township where the educational institution is located. The term
4 shall include any adjacent community where off-campus student
5 housing owned by or affiliated with the educational institution
6 is located.
7 "State-owned institution." Any institution that is a part of
8 the State System of Higher Education under Article XX-A of the
9 act of March 10, 1949 (P.L.30, No.14), known as the Public
10 School Code of 1949.
11 "State-related institution." The Pennsylvania State
12 University, the University of Pittsburgh, Temple University and
13 Lincoln University and their branch campuses.
14 Section 3. Report of disciplinary action.
15 (a) General rule.--Each educational institution shall submit
16 a quarterly report to the local governmental body of its host
17 community summarizing any disciplinary action taken against any
18 student attending the institution as a result of a criminal
19 conviction for criminal activity that occurred in the host
20 community and which was reported by the magisterial district
21 judge to the educational institution or obtained by the
22 institution through the Common Pleas Case Management System or
23 similar system established by the Administrative Office of
24 Pennsylvania Courts. The report shall be submitted to the local
25 governmental body on a quarterly basis. This report shall not
26 apply to summary offenses for traffic violations under 75
27 Pa.C.S. (relating to vehicles).
28 (b) Privacy of student.--A report under subsection (a) shall
29 not violate the privacy of a student by revealing any personal
30 information as required by Federal or State law.

1 Section 20. Effective date.
2 This act shall take effect in 60 days.
