AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," providing for Healthy Living 12 Committee discount. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 16 as The Insurance Company Law of 1921, is amended by adding a 17 section to read: 18 Section 635.2. Healthy Living Committee Discount.--(a) An 19 employer purchasing a health insurance policy may apply to the 20 Insurance Department for certification of any established 21 Healthy Living Committee in its workplace developed for the 22 purpose of helping employes live longer, healthier lives by
1 promoting health and wellness among employes. The Insurance 2 Department shall determine the qualifications for certification 3 of a Healthy Living Committee. 4 (b) Upon the renewal of an employer's health insurance 5 policy next following receipt of Insurance Department 6 certification, the employer shall receive a five percentum (5%) 7 discount in the rate or rates applicable to the policy for a 8 period of one year. The employer shall be entitled to the five 9 percentum (5%) discount for a total of five years if the 10 employer, by affidavit, provides annual verification to the 11 department and to the insurer that the Healthy Living Committee 12 continues to operate and meet the certification requirements. 13 (c) As used in this section: 14 (1) "Health insurance policy" means any group health 15 insurance policy, subscriber contract, certificate or plan that 16 provides medical or health care coverage by any health care 17 facility or licensed health care provider which is offered by or 18 is governed under this act or any of the following: 19 (i) Article XXIV of this act. 20 (ii) The act of December 29, 1972 (P.L.1701, No.364), known 21 as the "Health Maintenance Organization Act." 22 (iii) The act of May 18, 1976 (P.L.123, No.54), known as the 23 "Individual Accident and Sickness Insurance Minimum Standards 24 Act." 25 (iv) A nonprofit corporation subject to 40 Pa.C.S. Chs. 61 26 (relating to hospital plan corporations) and 63 (relating to 27 professional health services plan corporations). 28 (2) The term "insurer" means any entity that issues a group 29 health insurance policy, contract or plan described under clause 30 (1) of this subsection. 20080S1267B1729 - 2 -
