                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for medical
     4     assistance reimbursements for organ transplant drugs.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     8  as the Public Welfare Code, is amended by adding a section to
     9  read:
    10     Section 449.1.  Medical Assistance Reimbursements for Organ
    11  Transplant Drugs.--For purposes of medical assistance
    12  reimbursements an immunosuppressive drug shall not be subject to
    13  prior authorization, step therapy, generic substitution or
    14  quantity limits without notification to the patient and the
    15  consent of the prescribing physician. For purposes of this
    16  section, "immunosuppressive drug" means a drug that is used in
    17  immunosuppressive therapy to inhibit or prevent activity of the
    18  immune system, and is used to prevent the rejection of


     1  transplanted organs and tissue.
     2     Section 2.  This act shall take effect in 60 days.
