           ERICKSON, ORIE, EARLL, RAFFERTY, ROBBINS, D. WHITE, REGOLA,
           COSTA, O'PAKE, KASUNIC, WAUGH, DINNIMAN, WONDERLING, PILEGGI,
           SCARNATI, FUMO AND A. WILLIAMS, DECEMBER 7, 2007

        AS AMENDED ON THIRD CONSIDERATION, FEBRUARY 5, 2008

                                     AN ACT

     1  Amending Title 74 (Transportation) of the Pennsylvania
     2     Consolidated Statutes, providing for logging of certain
     3     aircraft flights.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5302 of Title 74 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5302.  Aircraft for official use.
     9     (a)  General rule.--The department may purchase or lease and
    10  maintain aircraft required for the proper conduct of the
    11  business of the Commonwealth agencies and the General Assembly.
    12  The total cost, including all ordinary and necessary expenses
    13  for the use of such aircraft, shall be charged by the department
    14  to the using agency or the General Assembly. The amount of such
    15  charge shall be paid into the Aviation Restricted Account and be
    16  credited to the amounts appropriated therefrom for the use of
    17  the department. All amounts so credited are hereby appropriated


     1  to the department for the same purposes as other appropriations
     2  out of the Aviation Restricted Account for the use of the
     3  department. The department shall establish and maintain a log of
     4  EXECUTIVE AND PASSENGER flights using aircraft authorized under   <--
     5  this section. This log shall be publicly accessible on the
     6  department's Internet website and shall be updated monthly, if    <--
     7  not more frequently. At minimum, the information made available
     8  on the department's Internet website shall include:
     9         (1)  Flight date.
    10         (2)  Flight identification number.
    11         (3)  Agency name.
    12         (4)  Aircraft.
    13         (5)  Originating city.
    14         (6)  Departure time.
    15         (7)  Destination city. If a flight includes more than one
    16     destination city, all destination cities shall be identified
    17     for such a flight.
    18         (8)  Arrival time.
    19         (9)  All passengers, including first and last names and
    20     titles.
    21         (10)  Public purpose of the trip.
    22         (11)  Total hours.
    23         (12)  Invoice amount.
    24     (b)  Manner of posting.--All information required by
    25  subsection (a) shall be posted in a way that allows the public
    26  to search the information by the categories enumerated in
    27  subsection (a)(1) through (12).
    28     Section 2.  This act shall take effect in 60 days.
