SENATE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for limited
     3     Internet access for certain sex offenders.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 9795.6.  Limited Internet access.
     9     (a)  General rule.--A person subject to the registration
    10  requirements of this subchapter who is found to have utilized
    11  the Internet to facilitate commission of any offense referred to
    12  in section 9795.1 (relating to registration) shall be prohibited
    13  from using the Internet, except as set forth in this section.
    14     (b)  Exception.--A person subject to limited Internet access
    15  under subsection (a) may be authorized by a parole or probation
    16  officer or by order of court to access the Internet for the
    17  purpose of engaging in or seeking employment or for other
    18  employment-related purposes.

     1     (c)  Periodic inspection.--A person subject to limited
     2  Internet access under subsection (a) shall be required to submit
     3  to periodic, unannounced inspection and examination of all
     4  computers and computer-related equipment owned or possessed by
     5  the person, as directed by a parole or probation officer or by
     6  order of court.
     7     (d)  Key logging.--A person subject to limited Internet
     8  access under subsection (a) may be required to install, at the
     9  person's expense, one or more key logging programs or such other
    10  hardware or software designed to monitor computer usage as the
    11  parole or probation officer, or the court, shall direct.
    12     Section 2.  The addition of 42 Pa.C.S. § 9795.6 shall apply
    13  to all offenders whether convicted before or after the effective
    14  date of this act.
    15     Section 3.  This act shall take effect in 60 days.
