SENATE BILL

        INTRODUCED BY BAKER, WAUGH, MUSTO, BOSCOLA, RAFFERTY AND
           RHOADES, JUNE 20, 2007

        AS AMENDED ON THIRD CONSIDERATION, FEBRUARY 5, 2008

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     providing for emergency services.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2403 of the act of June 23, 1931
     8  (P.L.932, No.317), known as The Third Class City Code, reenacted
     9  and amended June 28, 1951 (P.L.662, No.164), is amended by
    10  adding a clause to read:
    11     Section 2403.  Specific Powers.--In addition to other powers
    12  granted by this act, the council of each city shall have power,
    13  by ordinance:

    15     69.  Emergency Services.--To ensure that fire and emergency    <--
    16  medical services are provided within the city and to determine
    17  and provide the appropriate financial and administrative
    18  assistance necessary for these services in order to protect the


     1  health, safety and welfare of its citizenry. The city shall
     2  require any emergency services organization receiving city funds
     3  to provide to the city an annual itemized listing of all
     4  expenditures of these funds before the city may consider
     5  budgeting additional funding to the organization.
     6     69.  EMERGENCY SERVICES.--(A)  THE CITY SHALL BE RESPONSIBLE   <--
     7  FOR ENSURING THAT FIRE AND EMERGENCY MEDICAL SERVICES ARE
     8  PROVIDED WITHIN THE CITY BY THE MEANS AND TO THE EXTENT
     9  DETERMINED BY THE CITY, INCLUDING THE APPROPRIATE FINANCIAL AND
    10  ADMINISTRATIVE ASSISTANCE FOR THESE SERVICES.
    11     (B)  THE CITY SHALL CONSULT WITH FIRE AND EMERGENCY MEDICAL
    12  SERVICES PROVIDERS TO DISCUSS THE EMERGENCY SERVICES NEEDS OF
    13  THE CITY.
    14     (C)  THE CITY SHALL REQUIRE ANY EMERGENCY SERVICES
    15  ORGANIZATIONS RECEIVING CITY FUNDS TO PROVIDE TO THE CITY AN
    16  ANNUAL ITEMIZED LISTING OF ALL EXPENDITURES OF THESE FUNDS
    17  BEFORE THE CITY MAY CONSIDER BUDGETING ADDITIONAL FUNDING TO THE
    18  ORGANIZATION.
    19     Section 2.  This act shall take effect in 60 days.
