        INTRODUCED BY BAKER, WAUGH, MUSTO, BOSCOLA, RAFFERTY AND
           RHOADES, JUNE 20, 2007

        SENATOR REGOLA, LOCAL GOVERNMENT, AS AMENDED, DECEMBER 5, 2007

                                     AN ACT

     1  Amending the act of June 23, 1931 (P.L.932, No.317), entitled
     2     "An act relating to cities of the third class; and amending,
     3     revising, and consolidating the law relating thereto,"
     4     providing for emergency services.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The act of June 23, 1931 (P.L.932, No.317), known  <--
     8  as The Third Class City Code, reenacted and amended June 28,
     9  1951 (P.L.662, No.164), is amended by adding a section to read:
    10     Section 2110.  Emergency Services.--Each third class city
    11  shall be responsible for ensuring that fire and emergency
    12  medical services are provided within the city and shall
    13  determine and provide the appropriate financial and
    14  administrative assistance necessary for these services in order
    15  to protect the health, safety and welfare of its citizenry. The
    16  city shall require any emergency services organization 
    17  receiving city funds to provide to the city an annual itemized
    18  listing of all expenditures of these funds before the city may


     1  consider budgeting additional funding to the organization.
     2     Section 2.  This act shall take effect in 60 days.
     3     SECTION 1.  SECTION 2403 OF THE ACT OF JUNE 23, 1931           <--
     4  (P.L.932, NO.317), KNOWN AS THE THIRD CLASS CITY CODE, REENACTED
     5  AND AMENDED JUNE 28, 1951 (P.L.662, NO.164), IS AMENDED BY
     6  ADDING A CLAUSE TO READ:
     7     SECTION 2403.  SPECIFIC POWERS.--IN ADDITION TO OTHER POWERS
     8  GRANTED BY THIS ACT, THE COUNCIL OF EACH CITY SHALL HAVE POWER,
     9  BY ORDINANCE:
    10     * * *
    11     69.  EMERGENCY SERVICES.--TO ENSURE THAT FIRE AND EMERGENCY
    12  MEDICAL SERVICES ARE PROVIDED WITHIN THE CITY AND TO DETERMINE
    13  AND PROVIDE THE APPROPRIATE FINANCIAL AND ADMINISTRATIVE
    14  ASSISTANCE NECESSARY FOR THESE SERVICES IN ORDER TO PROTECT THE
    15  HEALTH, SAFETY AND WELFARE OF ITS CITIZENRY. THE CITY SHALL
    16  REQUIRE ANY EMERGENCY SERVICES ORGANIZATION RECEIVING CITY FUNDS
    17  TO PROVIDE TO THE CITY AN ANNUAL ITEMIZED LISTING OF ALL
    18  EXPENDITURES OF THESE FUNDS BEFORE THE CITY MAY CONSIDER
    19  BUDGETING ADDITIONAL FUNDING TO THE ORGANIZATION.
    20     SECTION 2.  THIS ACT SHALL TAKE EFFECT IN 60 DAYS.
