AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for reporting of 6 secondary school athletics equity. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known 10 as the Public School Code of 1949, is amended by adding a 11 article to read: 12 ARTICLE XVI-C 13 REPORTING OF SECONDARY SCHOOL ATHLETICS EQUITY 14 Section 1601-C. Scope of article. 15 This article requires reporting by school entities on 16 athletic opportunities afforded to male and female secondary 17 school students. 18 Section 1602-C. Definitions. 19 The following words and phrases when used in this act shall
1 have the meanings given to them in this section unless the 2 context clearly indicates otherwise: 3 "Department." The Department of Education of the 4 Commonwealth. 5 "School entity." A school district, a joint school, an area 6 vocational-technical school or charter school that provides 7 interscholastic athletic opportunities for secondary school 8 students. 9 "Secondary school student." A student who attends a school 10 entity in grade 7 through grade 12. 11 Section 1603-C. Duty to report. 12 (a) Information.--A school entity shall annually submit 13 information to the department regarding athletic opportunity for 14 male and female secondary school students. The required 15 information, as set forth in this article, shall pertain to 16 current interscholastic athletic teams that provide secondary 17 school student athletic opportunities in a school entity. 18 (b) Reporting form.--The information shall be submitted on a 19 reporting form and in a manner to be established by the 20 department. 21 (c) Submission.--The completed reporting form shall be 22 submitted to the department by October 15 of each year for the 23 immediately preceding school year. 24 (d) Public access.--A school entity shall make a copy of the 25 completed reporting form available for public inspection during 26 regular business hours. A school entity may make a copy of the 27 completed report available for public inspection on the publicly 28 accessible Internet website of the school entity, if one is 29 maintained. The completed reporting form shall constitute a 30 public record subject to public inspection under the act of June 20070S0985B1192 - 2 -
1 21, 1957 (P.L.390, No.212), referred to as the Right-to-Know 2 Law. 3 Section 1604-C. Department duties. 4 (a) Duties.--The department shall establish a reporting form 5 for the submission of the required information for the 6 immediately preceding school year by school entities. The 7 department shall provide for the distribution of the reporting 8 form through the department's Internet website, and shall 9 provide technical assistance to school entities. 10 (b) Reporting form information.--The following information 11 shall be included in the reporting form: 12 (1) The total number of students by gender in each 13 school entity and in each secondary school within a school 14 entity as of October 1 of the immediately preceding school 15 year. 16 (2) A listing by gender of the interscholastic athletic 17 teams that competed in athletic competition, including 18 categorization of the following information for each athletic 19 team including varsity, junior varsity and freshman athletic 20 teams. 21 (i) The total number of participants as of the day 22 of the first scheduled competition for each 23 interscholastic athletic team by gender, listing 24 separately the number of participants on each varsity, 25 junior varsity and freshman athletic team. 26 (ii) For the initial reported school year, the 27 school year in which each interscholastic athletic team 28 was established. For each subsequent reported school 29 year, a listing of interscholastic athletic teams that 30 were newly established or reestablished during the 20070S0985B1192 - 3 -
1 reported school year. 2 (iii) The seasons during which each interscholastic 3 athletic team competed. 4 (iv) The total expenditures for each interscholastic 5 athletic team in the reported school year, which shall 6 include the following data: 7 (A) The total amount of expenditures for 8 transportation. 9 (B) The total amount of expenditures for entry 10 fees to participate in athletic competitions, if any. 11 (C) The total amount of expenditures for 12 athletic equipment, including expenditures for the 13 purchase and any schedule for the replacement of 14 athletic equipment and team uniforms. 15 (D) Both capital budget and maintenance 16 expenditures for sports facilities, including 17 improvements to or expansion of sports facilities, 18 rentals of sports facilities, maintenance and repair 19 of sports facilities. For the purposes of this 20 subparagraph, sports facilities shall include locker 21 rooms, fields and gymnasiums. 22 (v) The total number of trainers by employment 23 status (full-time, part-time, head and assistant). 24 (vi) The total number of coaches by status (full- 25 time, part-time, head and assistant). 26 (vii) The total number of competitions scheduled. 27 (c) Copies.--The department shall make copies of all 28 submitted reports available for public inspection on the 29 department's publicly accessible Internet website. 30 (d) Annual report.--The department shall prepare and submit 20070S0985B1192 - 4 -
1 an annual report to the General Assembly regarding the 2 compliance with the reporting requirements of this article and 3 the expenditures and participation rates regarding 4 interscholastic athletic opportunities for each gender, and 5 other such information as the department deems relevant. 6 Section 1605-C. Regulations. 7 The department may promulgate any rules, regulations or 8 standards to administer this article. 9 Section 2. This act shall take effect in 180 days. F14L24SFL/20070S0985B1192 - 5 -
