                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     stalking.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2709.1(c) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2709.1.  Stalking.
     9     * * *
    10     (c)  Grading.--
    11         (1)  Except as otherwise provided for in [paragraph (2),
    12     a first] this subsection, an offense under this section shall
    13     constitute a misdemeanor of the first degree.
    14         (2)  A second or subsequent offense under this section or
    15     a first offense under [subsection (a)] this section if the
    16     person has been previously convicted of a crime of violence
    17     involving the same victim, family or household member,
    18     including, but not limited to, a violation of section 2701

     1     (relating to simple assault), 2702 (relating to aggravated
     2     assault), 2705 (relating to recklessly endangering another
     3     person), 2901 (relating to kidnapping), 3121 (relating to
     4     rape) or 3123 (relating to involuntary deviate sexual
     5     intercourse), an order issued under section 4954 (relating to
     6     protective orders) or an order issued under 23 Pa.C.S. § 6108
     7     (relating to relief) or if the person is convicted of
     8     committing any other misdemeanor during the course of this
     9     offense shall constitute a felony of the third degree.

    11     Section 2.  This act shall take effect in 60 days.
