AN ACT 1 Amending Title 65 (Public Officers) of the Pennsylvania 2 Consolidated Statutes, further defining "candidate." 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. The definition of "candidate" in section 1102 of 6 Title 65 of the Pennsylvania Consolidated Statutes is amended to 7 read: 8 § 1102. Definitions. 9 The following words and phrases when used in this chapter 10 shall have, unless the context clearly indicates otherwise, the 11 meanings given to them in this section: 12 * * * 13 "Candidate." Any individual who seeks nomination or election 14 to public office by vote of the electorate, other than a judge 15 of elections, inspector of elections or official of a political 16 party, whether or not such individual is nominated or elected. 17 An individual shall be deemed to be seeking nomination or
1 election to such office if he has: 2 (1) received a contribution or made an expenditure or 3 given his consent for any other person or committee to 4 receive a contribution or make an expenditure for the purpose 5 of influencing his nomination or election to such office, 6 whether or not the individual has announced the specific 7 office for which he will seek nomination or election at the 8 time the contribution is received or the expenditure is made; 9 or 10 (2) taken the action necessary under the laws of this 11 Commonwealth to qualify himself for nomination or election to 12 such office. 13 The term shall include individuals nominated or elected as 14 write-in candidates unless they resign such nomination or 15 elected office within 30 days of having been nominated or 16 elected. The term shall also include any individual seeking 17 nomination or election as a judicial officer except judicial 18 officers who are seeking retention pursuant to 42 Pa.C.S. § 3153 19 (relating to retention elections after regular term). 20 * * * 21 Section 2.
