        INTRODUCED BY VANCE, WASHINGTON, ERICKSON, ARMSTRONG, BOSCOLA,
           BROWNE, BRUBAKER, COSTA, FERLO, FOLMER, FONTANA, LOGAN,
           MUSTO, O'PAKE, ORIE, PICCOLA, PILEGGI, PIPPY, PUNT, RAFFERTY,
           STACK, TOMLINSON, WAUGH, C. WILLIAMS, WONDERLING AND WOZNIAK,

        REFERRED TO AGING AND YOUTH, MAY 8, 2007

                                     AN ACT

     1  Providing for long-term living facility licensure information;
     2     and imposing duties on the Department of Aging, the
     3     Department of Health and the Department of Public Welfare.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Long-Term
     8  Living Facility Licensure Information Act.
     9  Section 2.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Department."  The Department of Aging of the Commonwealth.
    14     "Facility."  Any of the following:
    15         (1)  A domiciliary care home as defined in section 2202-A
    16     of the act of April 9, 1929 (P.L.177, No.175), known as The
    17     Administrative Code of 1929.

     1         (2)  A personal care home as defined in section 1001 of
     2     the act of June 13, 1967 (P.L.31, No.21), known as the Public
     3     Welfare Code.
     4         (3)  A long-term care nursing facility as defined in
     5     section 802.1 of the act of July 19, 1979 (P.L.130, No.48),
     6     known as the Health Care Facilities Act.
     7  Section 3.  Disclosure of licensing information.
     8     The department shall maintain a listing on its publicly
     9  accessible Internet website for each type of facility. The
    10  listing shall be updated at least monthly and shall include, but
    11  not be limited to:
    12         (1)  The name, address and telephone number of the
    13     facility.
    14         (2)  The name, mailing address and telephone number of
    15     the owner or managing company of the facility.
    16         (3)  The department responsible for licensing or
    17     certifying the facility.
    18         (4)  The capacity for which the facility has been
    19     licensed or certified.
    20         (5)  The status of the license or certification issued.
    21         (6)  The date the current license or certification was
    22     issued and the date it expires.
    23         (7)  The date of the most recent inspection of the
    24     facility by the licensing or certifying department.
    25         (8)  Any violations by the facility of Federal or State
    26     statutes or regulations within the preceding 24 months.
    27         (9)  Enforcement actions taken or penalties assessed
    28     against the facility within the preceding 24 months.
    29         (10)  Corrective actions required by the licensing or
    30     certifying department and taken by the facility.

     1  Section 4.  Collection of information.
     2     (a)  General rule.--The Department of Health and the
     3  Department of Public Welfare shall cooperate with and provide
     4  information to the department as necessary to establish and
     5  maintain the Internet website.
     6     (b)  Exception.--Nothing in this act shall require the
     7  department to collect information from any facility it does not
     8  license or certify.
     9  Section 5.  Effective date.
    10     This act shall take effect in 60 days.
