AN ACT
1 Providing for the capital budget for the fiscal year 2007-2008.
2 The General Assembly of the Commonwealth of Pennsylvania
3 hereby enacts as follows:
4 Section 1. Short title and construction.
5 (a) Short title.--This act shall be known and may be cited
6 as the Capital Budget Act of 2007-2008.
7 (b) Supplements.--A reference to this act shall be deemed to
8 include a reference to the supplements to this act.
9 (c) Capital Facilities Debt Enabling Act.--The provisions
10 and definitions of Chapter 3 of the act of February 9, 1999
11 (P.L.1, No.1), known as The Capital Facilities Debt Enabling
12 Act, shall apply to this act to the extent they are not
13 inconsistent with this act.
14 Section 2. Overall limitations on debt to be incurred for
15 capital projects.
16 The maximum principal amount of additional debt to be
17 incurred during the 2007-2008 fiscal year for capital projects
1 specifically itemized in a capital budget pursuant to section
2 7(a)(4) of Article VIII of the Constitution of Pennsylvania, and
3 the fund to be charged with the repayment of such debt, shall,
4 with respect to each category of capital projects, be as
5 follows:

11 applicable
12 (2) Furniture and General Fund or

17 (4) Redevelopment
18 Assistance Projects 250,000,000 General Fund
19 (5) Flood Control
20 Projects 7,000,000 General Fund
21 Total $752,000,000
22 SECTION 3. PAYMENT OF SETTLEMENT OR AWARDS OF CLAIMS. <--
23 NOTWITHSTANDING THE PROVISIONS OF 62 PA.C.S. § 1726 (RELATING
24 TO PAYMENT OF AWARDS AND COSTS), FOR FISCAL YEAR 2007-2008 THE
25 SETTLEMENT OR AWARD OF CLAIMS ARISING FROM CONSTRUCTION
26 CONTRACTS FOR PUBLIC IMPROVEMENT PROJECTS MAY BE PAID BY THE
27 DEPARTMENT OF GENERAL SERVICES FROM AVAILABLE FUNDS IN ACCOUNTS
28 WITHIN THE CAPITAL FACILITIES FUND THAT INCLUDE FUNDS NO LONGER
29 REQUIRED FOR THE DESIGN, ACQUISITION OR CONSTRUCTION OF ANY
30 APPROVED CAPITAL PROJECT.

1 Section 3 4. Effective date. <--
2 This act shall take effect July 1, 2007, or immediately,
3 whichever is later.
