        INTRODUCED BY PILEGGI, CORMAN, ORIE, SCARNATI, WAUGH, ARMSTRONG,
           ROBBINS, BOSCOLA, GORDNER, TOMLINSON, ERICKSON, KASUNIC,
           EARLL, FOLMER, PIPPY, RAFFERTY, PICCOLA, REGOLA, WONDERLING,
           BROWNE, BRUBAKER AND D. WHITE, APRIL 2, 2007

        AS AMENDED ON THIRD CONSIDERATION, MAY 21, 2007

                                     AN ACT

     1  Requiring the posting of certain State GOVERNMENTAL salary        <--
     2     information on the Internet.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the State          <--
     7  GOVERNMENTAL Salary Information Act.                              <--
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Commonwealth agency."  Any of the following:
    13         (1)  The Governor, Lieutenant Governor, Attorney General,
    14     Auditor General, State Treasurer and the departments,
    15     offices, boards, authorities, commissions and other agencies
    16     of the executive branch of the government of the
    17     Commonwealth, whether or not subject to the supervision and

     1     control of the Governor.
     2         (2)  The legislative branch of government of the
     3     Commonwealth.
     4         (3)  Any court and any office of the unified judicial
     5     system of the Commonwealth.
     6     "LOCAL AGENCY."  A COUNTY, TOWNSHIP, BOROUGH, TOWN, CITY,      <--
     7  SCHOOL DISTRICT, LOCAL AUTHORITY, COMMISSION OR OTHER SIMILAR
     8  ENTITY PERFORMING A GOVERNMENTAL FUNCTION.
     9  Section 3.  Online posting of salaries.
    10     (a)  General rule.--The State Treasurer shall establish an
    11  official Internet website where it shall post, and update on a
    12  monthly basis, the following information concerning the officers
    13  and employees described in section 4:
    14         (1)  Name.
    15         (2)  Title.
    16         (3)  Agency, department or other institution.
    17         (4)  Annual salary rate or other rate of compensation.
    18         (5)  Supplemental compensation for the current month. For
    19     purposes of this section, supplemental compensation shall not
    20     include reimbursement payments to employees for appropriate
    21     business expenditures, or payments for unused vacation or
    22     unused sick leave.
    23     (b)  Data.--Each agency shall create and maintain the data
    24  required by subsection (a) in a form and structure prescribed by  <--
    25  ASCII-DELIMITED TEXT FORMAT, EXCEL SPREADSHEET FORMAT OR ANOTHER  <--
    26  FORMAT MUTUALLY AGREED UPON BY THE AGENCY AND the State
    27  Treasurer.
    28     (c)  Accuracy.--Each agency is responsible for verifying the
    29  accuracy and completeness of the information that it submits to
    30  the State Treasurer.

     1  Section 4.  Applicability.
     2     (a)  General rule.--The provisions of section 3 shall apply
     3  to all officers and employees of a Commonwealth agency.
     4     (b)  Legislative employees.--For each officer or employee of
     5  the Senate and the House of Representatives, in addition to the
     6  information required by section 3, the State Treasurer shall
     7  separately indicate whether the officer or employee is paid with
     8  funds controlled by the majority caucus, funds controlled by the
     9  minority caucus or funds appropriated to compensate the staff of
    10  the officers elected by the Senate or the House of
    11  Representatives.
    12     (C)  REDACTION.--AT THE REQUEST OF AN AGENCY, THE STATE        <--
    13  TREASURER MAY REDACT THE NAME OF AN INDIVIDUAL WHO IS REGULARLY
    14  INVOLVED IN THE CONDUCT OF UNDERCOVER CRIMINAL INVESTIGATIONS IF
    15  THE STATE TREASURER DETERMINES IT IS NECESSARY TO PROTECT THE
    16  SAFETY OF THE INDIVIDUAL.
    17  SECTION 5.  LOCAL AGENCIES.
    18     (A)  GENERAL RULE.--ALL LOCAL AGENCIES SHALL POST ON THEIR
    19  OFFICIAL INTERNET WEBSITES, AND UPDATE ON A MONTHLY BASIS, THE
    20  FOLLOWING CONCERNING OFFICERS AND EMPLOYEES:
    21         (1)  NAME.
    22         (2)  TITLE.
    23         (3)  AGENCY, DEPARTMENT OR OTHER INSTITUTION.
    24         (4)  ANNUAL SALARY RATE OR OTHER RATE OF COMPENSATION.
    25         (5)  SUPPLEMENTAL COMPENSATION FOR THE CURRENT MONTH. FOR
    26     PURPOSES OF THIS SECTION, SUPPLEMENTAL COMPENSATION SHALL NOT
    27     INCLUDE REIMBURSEMENT PAYMENTS TO EMPLOYEES FOR APPROPRIATE
    28     BUSINESS EXPENDITURES, OR PAYMENTS FOR UNUSED VACATION OR
    29     UNUSED SICK LEAVE.
    30     (B)  EXCEPTION.--IF THE LOCAL AGENCY DOES NOT MAINTAIN AN

     1  OFFICIAL INTERNET WEBSITE, THE INFORMATION SHALL BE MADE
     2  AVAILABLE ELECTRONICALLY OR IN WRITING UPON REQUEST WITHIN FIVE
     3  DAYS.
     4     (C)  NOTIFICATION.--EACH LOCAL AGENCY SHALL NOTIFY THE STATE
     5  TREASURER, IN A FORM AND STRUCTURE PRESCRIBED BY THE STATE
     6  TREASURER, WHEN IT HAS COMPLIED WITH THIS ACT. WHEN APPLICABLE,
     7  THE NOTIFICATION SHALL INCLUDE THE MAIN INTERNET WEBSITE PAGE
     8  ADDRESS WHERE THE DATA RECEIVED PURSUANT TO SUBSECTION (A) IS
     9  LOCATED.
    10     (D)  DIRECTORY.--THE STATE TREASURER SHALL MAINTAIN AN
    11  INTERNET WEBSITE-BASED DIRECTORY OF THE LOCAL AGENCY INTERNET
    12  WEBSITE PAGE ADDRESSES RECEIVED PURSUANT TO SUBSECTION (C) ON
    13  THE OFFICIAL INTERNET WEBSITE CREATED PURSUANT TO SUBSECTION
    14  (A).
    15  Section 5 6.  Commercial use of data prohibited.                  <--
    16     It shall be unlawful for any person to use the contents of
    17  the posting of information under this act for any commercial
    18  purpose whatsoever.
    19  Section 6 7.  Effective date.                                     <--
    20     This act shall take effect July 1, 2007, or immediately,
    21  whichever is later.
