AN ACT
1 Amending Title 35 (Health and Safety) of the Pennsylvania
2 Consolidated Statutes, providing that the Director of the
3 Pennsylvania Emergency Management Agency be appointed subject
4 to confirmation by the Senate.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 7312(e) of Title 35 of the Pennsylvania
8 Consolidated Statutes is amended to read:
9 § 7312. Organization.
10 This agency shall consist of and be organized substantially
11 as follows:

13 (e) State director.--To supervise the work and activities
14 comprising the State Civil Defense and Disaster Program, the
15 Governor shall appoint, subject to the consent of a majority of
16 the members elected to the Senate, an individual to act, on a
17 full-time basis, as director of the agency. The director shall
1 perform all such fiscal, planning, administrative, operational
2 and other duties as may be assigned to him by the council and
3 shall act as the chairman's principal assistant in civil defense
4 and disaster matters. The director or the director's designee is
5 also the State coordinating officer responsible to coordinate
6 and supervise the Commonwealth and local disaster response
7 effort following a presidential declaration of an emergency or a
8 major disaster.

10 Section 2. The Governor shall nominate a person for the
11 position of Director of the Pennsylvania Emergency Management
12 Agency within 30 days of the effective date of this section.
13 Section 3. This act shall take effect immediately.
