           FONTANA, O'PAKE, BROWNE AND LOGAN, MARCH 19, 2007

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for exceptions to
     3     prohibition of interception and disclosure of communications.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5704 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a paragraph to read:
     8  § 5704.  Exceptions to prohibition of interception and
     9             disclosure of communications.
    10     It shall not be unlawful and no prior court approval shall be
    11  required under this chapter for:

    13         (17)  An investigative or law enforcement officer or a
    14     person acting at the direction or request of an investigative
    15     or law enforcement officer may intercept a wire or oral
    16     communication involving suspected criminal activities if the
    17     officer or the person is a party to the communication and is
    18     involved in an undercover narcotics investigation and there

     1     is reasonable cause to believe that the other party to the
     2     communication is violating the act of April 14, 1972
     3     (P.L.233, No.64), known as The Controlled Substance, Drug,
     4     Device and Cosmetic Act, with respect to the delivery of
     5     illegal narcotics.
     6     Section 2.  This act shall take effect in 60 days.
