AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, establishing the offense of domestic
3 assault.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 2718. Domestic assault.
9 (a) Offense defined.--A person who violates section 2701
10 (relating to simple assault) or 2702 (relating to aggravated
11 assault) where the victim is a family or household member of the
12 perpetrator is guilty of domestic assault and, in addition to
13 any other penalty prescribed by law, shall be sentenced to:
14 (1) A minimum sentence of at least one year of total
15 confinement when the offense is a second offense.
16 (2) A minimum sentence of at least five years of total
17 confinement when the offense is a third or subsequent
18 offense.
1 (b) Definition.--As used in this section, the term "family
2 or household member" means a spouse or person who has been a
3 spouse, person living as a spouse or who lived as a spouse or a
4 current or former sexual or intimate partner.
5 Section 2. This act shall take effect in 60 days.
