AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," providing for health insurance 12 reimbursement for prostate specific antigen examinations. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 16 as The Insurance Company Law of 1921, is amended by adding a 17 section to read: 18 Section 635.2. Coverage for Prostate Specific Antigen 19 Examinations.--(a) Except as provided for in subsection (b), 20 every health care policy providing hospital or medical/surgical 21 coverage and all group or individual subscriber contracts or 22 certificates issued by any entity subject to 40 Pa.C.S. Ch. 61
1 (relating to hospital plan corporations) or 63 (relating to 2 professional health services plan corporations), this act, the 3 act of December 29, 1972 (P.L.1701, No.364), known as the 4 "Health Maintenance Organization Act" or an employe welfare 5 benefit plan as defined in section 3 of the Employee Retirement 6 Income Security Act of 1974 (Public Law 93-406, 88 Stat. 829) 7 providing hospital or medical/surgical coverage shall provide 8 coverage for prostate specific antigen (PSA) examinations. The 9 minimum coverage required shall include all costs associated 10 with a PSA examination every year for men 50 years of age or 11 older and with any PSA examination based on a physician's 12 recommendation for men under 50 years of age. 13 (b) The provisions of subsection (a) shall not apply to the 14 following types of insurance: 15 (1) Hospital indemnity. 16 (2) Accident. 17 (3) Specified disease. 18 (4) Disability income. 19 (5) Dental. 20 (6) Vision. 21 (7) Civilian Health and Medical Program of the Uniformed 22 Services (CHAMPUS) supplement. 23 (8) Medicare supplement. 24 (9) Long-term care. 25 (10) Other limited insurance plans. 26 Section 2.
