SENATE BILL

        INTRODUCED BY PIPPY, BOSCOLA, FONTANA, RAFFERTY, WONDERLING,
           RHOADES, COSTA, KITCHEN, ERICKSON, O'PAKE, PILEGGI,
           TOMLINSON, BRUBAKER, WOZNIAK, BROWNE AND LOGAN, MARCH 6, 2007

        SENATOR GREENLEAF, JUDICIARY, AS AMENDED, MARCH 27, 2007

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for impersonating a
     3     public servant.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4912 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 4912.  Impersonating a public servant, MEMBER OF THE ARMED      <--
     9             FORCES OR VETERAN.
    10     (a)  General rule.--A person commits a misdemeanor of the
    11  second degree if he falsely pretends to hold a position in the
    12  public service with intent to induce another to submit to such
    13  pretended official authority or otherwise to act in reliance
    14  upon that pretense to his prejudice.
    15     (b)  Law enforcement officer.--A person commits a felony of
    16  the third degree if by action, word or attire the person
    17  purports to be, or conveys the impression that the person is, a
    18  police officer or any other type of law enforcement officer,

     1  with intent to induce another person to submit to false official
     2  authority or to otherwise rely to his or her prejudice upon the
     3  false impression created.
     4     (C)  MEMBER OF ARMED FORCES OR VETERAN.--A PERSON COMMITS A    <--
     5  MISDEMEANOR OF THE THIRD DEGREE IF BY ACTION, WORD OR ATTIRE THE
     6  PERSON PURPORTS TO BE, OR CONVEYS THE IMPRESSION THAT THE PERSON
     7  IS, AN ACTIVE MEMBER OF THE ARMED FORCES OR A VETERAN, WITH
     8  INTENT TO INDUCE ANOTHER PERSON TO SUBMIT TO FALSE OFFICIAL
     9  AUTHORITY OR TO OTHERWISE RELY TO HIS OR HER PREJUDICE UPON THE
    10  FALSE IMPRESSION CREATED.
    11     (D)  DEFINITION.--AS USED IN THIS SECTION THE TERM "VETERAN"
    12  MEANS A PERSON WHO SERVED OR AFTER THE EFFECTIVE DATE OF THIS
    13  SUBSECTION SERVES IN THE ARMED FORCES OF THE UNITED STATES, OR
    14  IN ANY WOMEN'S ORGANIZATION OFFICIALLY CONNECTED THEREWITH,
    15  DURING ANY WAR OR ARMED CONFLICT IN WHICH THE UNITED STATES
    16  ENGAGED AND WHO WAS RELEASED FROM ACTIVE DUTY UNDER HONORABLE
    17  CONDITIONS, OTHER THAN FROM PERIODS OF ACTIVE DUTY FOR TRAINING,
    18  OR WITH AN HONORABLE DISCHARGE FROM SUCH SERVICE, OR A PERSON
    19  WHO SO SERVED OR AFTER THE EFFECTIVE DATE OF THIS SUBSECTION
    20  SERVES IN THE ARMED FORCES OF THE UNITED STATES, OR IN ANY
    21  WOMEN'S ORGANIZATION OFFICIALLY CONNECTED THEREWITH, SINCE JULY
    22  27, 1953, INCLUDING SERVICE IN VIETNAM, AND WHO HAS AN HONORABLE
    23  DISCHARGE FROM SUCH SERVICE.
    24     Section 2.  This act shall take effect in 60 days.
