SENATE BILL

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for the use of alternate
     3     railroad lines in third class cities.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 66 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2710.  Use of alternate railroad lines in third class cities.
     9     All railroads operating in this Commonwealth that transport,
    10  within the boundaries of a third class city, a waste material to
    11  be used for beneficial use shall first consider and use any
    12  alternate railroad line that does not go through the municipal
    13  boundaries of the third class city. If, in the opinion of the
    14  commission, an alternate railroad line outside the boundaries of
    15  the third class city is not available to transport the waste
    16  material to be used for beneficial use, then the material may be
    17  transported on a railroad within the boundaries of the third
    18  class city, provided that the railroad line with the shortest

     1  distance within the city is used.
     2     Section 2.  This act shall take effect immediately.
