HOUSE RESOLUTION

No. 375 Session of 2007


        INTRODUCED BY SCHRODER, BAKER, BRENNAN, EVERETT, GINGRICH,
           HERSHEY, KORTZ, MAHER, MUSTIO, PALLONE, REICHLEY, ROAE,
           RUBLEY, SAMUELSON, SEIP AND SWANGER, JULY 14, 2007

        INTRODUCED AS NONCONTROVERSIAL RESOLUTION UNDER RULE 35,
           JULY 14, 2007

                                  A RESOLUTION

     1  Directing the Pennsylvania Gaming Control Board to complete the
     2     study on the interception of gaming winnings and to issue
     3     their recommendations on the study by September 1, 2007.

     4     WHEREAS, On July 5, 2004, Governor Ed Rendell signed into law
     5  the Pennsylvania Race Horse Development and Gaming Act; and
     6     WHEREAS, That act created the Pennsylvania Gaming Control
     7  Board and gave the board the general and sole regulatory
     8  authority over the conduct of gaming or related activities in
     9  this Commonwealth; and
    10     WHEREAS, Under the act, the board "shall conduct a study to
    11  determine the feasibility of implementing methods for the
    12  interception of the gaming winnings of individuals who are
    13  delinquent support obligors or tax delinquent. The study shall
    14  be completed by December 31, 2006, and shall contain
    15  recommendations which the board determines appropriate"; and
    16     WHEREAS, The Commonwealth already has provisions for the
    17  interception of winnings from the State Lottery, monetary awards


     1  from personal injury and workers' compensation claims
     2  settlements and State income tax refunds to satisfy delinquent
     3  support obligations; and
     4     WHEREAS, The payments of delinquent child support obligors
     5  are crucial for the well-being of many children throughout this
     6  Commonwealth; and
     7     WHEREAS, Currently the outstanding Statewide arrears are
     8  estimated at $1.8 billion; and
     9     WHEREAS, The board has not completed the study on the
    10  interception of gaming winnings by the December 31, 2006,
    11  deadline; and
    12     WHEREAS, The Pennsylvania Gaming Control Board has not issued
    13  recommendations which the board deems as appropriate for the
    14  interception of gaming winnings; therefore be it
    15     RESOLVED, That the House of Representatives direct the
    16  Pennsylvania Gaming Control Board to complete the study on the
    17  interception of gaming winnings and to issue their
    18  recommendations on this study by September 1, 2007; and be it
    19  further
    20     RESOLVED, That a copy of this resolution be transmitted to
    21  the members of the Pennsylvania Gaming Control Board and its
    22  Executive Director.
