THE GENERAL ASSEMBLY OF PENNSYLVANIA

HOUSE BILL

No. 2610 Session of 2008

INTRODUCED BY GEORGE, BELFANTI, GIBBONS, HARKINS, HORNAMAN,
JAMES, JOSEPHS, McILVAINE SMITH, M. O'BRIEN, PARKER,
PASHINSKI, PETRONE, K. SMITH, SURRA, THOMAS, WOJNAROSKI AND
           YOUNGBLOOD, JUNE 10, 2008

REFERRED TO COMMITTEE ON CONSUMER AFFAIRS, JUNE 10, 2008

                                     AN ACT

1 Providing for a moratorium on certain utility permits.

2 The General Assembly of the Commonwealth of Pennsylvania
     3 hereby enacts as follows:
     4 Section 1. Short title.
5 This act shall be known and may be cited as the Electric
6 Utility Competitive Bid Moratorium Act.
     7 Section 2. Policy declaration.
8 The General Assembly finds and declares as follows:
9 (1) The current rules stating that regulatory
10 authorities have only one business day to review the results
11 of competitive procurements and would consider even a shorter
12 review period on these auctions which could amount to the
13 sale of billions of dollars of electricity is not in the
    14 public interest.
15 (2) Recent developments in the competitive bidding
16 process demonstrate that generation costs under the current

     1 process could increase 100%.
2 (3) These price spikes would result in economic and
3 commercial discord and therefore it is in the public interest
4 for the General Assembly to intervene and reexamine and
5 objectively evaluate the competitive bidding process.
     6 Section 3. Definitions.
7 The following words and phrases when used in this act shall
8 have the meanings given to them in this section unless the
     9 context clearly indicates otherwise:
