AN ACT 1 Amending the act of December 10, 1974 (P.L.852, No.287), 2 entitled "An act to protect the public health and safety by 3 preventing excavation or demolition work from damaging 4 underground lines used in providing electricity, 5 communication, gas, propane, oil delivery, oil product 6 delivery, sewage, water or other service; imposing duties 7 upon the providers of such service, recorders of deeds, and 8 persons and other entities preparing drawings or performing 9 excavation or demolition work; and prescribing penalties," 10 further providing for definitions, for duties of facility 11 owners, for duties of a One Call System, for duties of 12 contractors and for fines and penalties. 13 The General Assembly of the Commonwealth of Pennsylvania 14 hereby enacts as follows: 15 Section 1. Section 2 of the act of December 10, 1974 16 (P.L.852, No.287), referred to as the Underground Utility Line 17 Protection Law, amended November 29, 2006 (P.L.1593, No.181), is 18 amended by adding paragraphs to read: 19 Section 2. It shall be the duty of each facility owner: 20 * * * 21 (12) To respond to all notices made through the One Call 22 System to terminate, disable or otherwise suspend any line or
1 facility. 2 (13) To develop and maintain a protocol for complying with 3 One Call System notices to terminate, disable or otherwise 4 suspend any line or facility. Each facility owner shall compile 5 and submit an annual report to the One Call System's board of 6 directors detailing each facility owner's protocol for verifying 7 its response to and compliance with all notices made through the 8 One Call System to terminate, disable or otherwise suspend any 9 line or facility. This report shall also be submitted to the 10 Pennsylvania Public Utility Commission for all facility owners 11 that fall under the jurisdiction of the Pennsylvania Public 12 Utility Commission. 13 Section 2.
