AN ACT 1 Making appropriations from the restricted revenue accounts 2 within the State Gaming Fund and from the State Gaming Fund 3 to the Pennsylvania Gaming Control Board, the Department of 4 Revenue, the Pennsylvania State Police and the Attorney 5 General for the fiscal year beginning July 1, 2008, to June 6 30, 2009, and for the payment of bills incurred and remaining 7 unpaid at the close of the fiscal year ending June 30, 2008. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 PART I 11 PRELIMINARY PROVISIONS 12 Section 101. Short title. 13 This act shall be known and may be cited as the Gaming 14 Control Appropriation Act of 2008. 15 PART III 16 STATE GAMING CONTROL 17 RESTRICTED REVENUE ACCOUNTS 18 Section 301. State Gaming Fund.--The following amounts set 19 forth in this part, or as much thereof as may be necessary, are
1 hereby appropriated from the State Gaming Fund restricted 2 revenue accounts under 4 Pa.C.S. § 1401 (relating to slot 3 machine licensee deposits) to the agencies of the Executive 4 Department named in this part for the purposes set forth for the 5 fiscal year beginning July 1, 2008, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2008. 8 Section 302. Attorney General.--The following 9 amounts are appropriated to the Attorney General: 10 For salaries, wages and all necessary expenses 11 of the Attorney General related to 4 Pa.C.S. Pt. 12 II (relating to gaming). 13 State appropriation.................... 942,000 <-- 14 STATE APPROPRIATION.................... 914,000 <-- 15 Section 303. Department of Revenue.--The 16 following amounts are appropriated to the 17 Department of Revenue: 18 For the salaries, wages and all necessary 19 expenses of the Department of Revenue related to 4 20 Pa.C.S. Pt. II (relating to gaming). 21 State appropriation.................... 10,091,000 <-- 22 STATE APPROPRIATION.................... 9,754,000 <-- 23 Section 304. Pennsylvania State Police.--The 24 following amounts are appropriated to the 25 Pennsylvania State Police. 26 For the salaries, wages and all necessary 27 expenses of the Pennsylvania State Police related 28 to 4 Pa.C.S. 1 PART V 2 STATE GAMING FUND 3 Section 501. State Gaming Fund.--The following amounts set 4 forth in this part, or as much thereof as may be necessary, are 5 hereby appropriated from the State Gaming Fund to the agencies 6 of the Executive Department named in this part for the purposes 7 set forth for the fiscal year beginning July 1, 2008, and for 8 the payment of bills incurred and remaining unpaid at the close 9 of the fiscal year ending June 30, 2008. 10 Section 502. Pennsylvania Gaming Control 11 Board.--The following amounts are appropriated to 12 the Pennsylvania Gaming Control Board. 13 For the salaries, wages and all necessary 14 expenses for the proper operation and 15 administration of the Pennsylvania Gaming Control 16 Board. This appropriation includes $9,208,000 <-- 17 $11,126,000 from the restricted revenue account <-- 18 established in the State Gaming Fund for fees and 19 other revenues collected by the board. 20 State appropriation.................... 34,719,000 <-- 21 STATE APPROPRIATION.................... 33,310,000 <-- 22 Section 503. Loan.--Unrestricted funds appropriated to the 23 Pennsylvania Gaming Control Board under this part in the amount 24 of $25,511,000 $22,184,000 shall constitute a loan and shall be <-- 25 repaid in the manner set forth in section (Upon enactment, the 26 Legislative Reference Bureau shall replace this blank with the 27 appropriate citation.) of the act of April 9, 1929 (P.L.343, 28 No.176), known as The Fiscal Code. The board shall defer 29 assessing slot machine licensees for repayment until such time 30 as 11 slot machine licenses have been issued and 11 licensed 20080H2458B4185 - 3 -
1 gaming entities have commenced the operation of slot machines. 2 PART VII 3 MISCELLANEOUS PROVISIONS 4 Section 701. Transfers prohibited.--There is no authority 5 for the State Treasurer, the Secretary of the Budget, the 6 Secretary of Revenue or the Pennsylvania Gaming Control Board to 7 transfer any money within or between the appropriations in Part 8 III or Part V. 9 Section 702.
