AN ACT
1 Relating to a fixed tuition rate by institutions of the
2 Pennsylvania State System of Higher Education for certain
3 undergraduate students.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Fixed tuition rate for undergraduate students.
7 (a) Fixed rate.--Except as otherwise provided by this
8 section, in a semester or other academic term, a university in
9 the Pennsylvania State System of Higher Education may not charge
10 tuition to an undergraduate student at a rate that exceeds the
11 rate the university charged the student during the first
12 semester or other academic term the student enrolled in the
13 university if the student is currently and at all times while
14 enrolled at the university has been a resident of this
15 Commonwealth and was otherwise entitled to pay tuition at the
16 rate provided for residents of this Commonwealth.
17 (b) Transfer students.--If a student enrolls in a university
18 after transferring from another public or private institution of
1 higher education, subsection (a) does not apply to the student
2 after the fourth anniversary of the date of that enrollment,
3 regardless of whether the student was ever previously enrolled
4 at the university.
5 (c) Other students.--For any other student enrolled in a
6 university, subsection (a) does not apply to the student after:
7 (1) the fourth anniversary of the date the student first
8 enrolls at the university, if the student is enrolled in a
9 four-year degree program; or
10 (2) the end of the standard completion period for the
11 degree program in which the student is enrolled, as
12 established by the university awarding the degree, if the
13 student is enrolled in a degree program other than a four-
14 year degree program.
15 (d) Notification.--Each university shall notify each
16 entering undergraduate student, including each undergraduate
17 student who transfers to the university, of the eligibility
18 requirements for a fixed tuition rate under this section.
19 (e) Applicability.--This section does not apply to a student
20 who enters a university for the first time before the 2008 fall
21 semester.
22 Section 2. Effective date.
23 This act shall take effect immediately or September 1, 2007,
24 whichever is later.
