                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for penalties for
     3     injuring or tampering with fire apparatus, hydrants, etc.,
     4     and for unauthorized use or opening of fire hydrants.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 3305 and 3306 of Title 18 of the
     8  Pennsylvania Consolidated Statutes are amended to read:
     9  § 3305.  Injuring or tampering with fire apparatus, hydrants,
    10             etc.
    11     Whoever willfully and maliciously cuts, injures, damages, or
    12  destroys or defaces any fire hydrant or any fire hose or fire
    13  engine, or other public or private fire equipment, or any
    14  apparatus appertaining to the same, commits a misdemeanor of the
    15  [third] second degree.
    16  § 3306.  Unauthorized use or opening of fire hydrants.
    17     Whoever opens for private usage any fire hydrant without
    18  authorization of the water authority or company having

     1  jurisdiction over such fire hydrant, commits a [summary offense]
     2  misdemeanor of the third degree.
     3     Section 2.  This act shall take effect in 60 days.
