                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," further providing for
     4     regulations for personal care homes and assisted living
     5     residences.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1057.3 heading and (a)(6) of the act of
     9  June 13, 1967 (P.L.31, No.21), known as the Public Welfare Code,
    10  amended July 25, 2007 (P.L.402, No.56), are amended to read:
    11     Section 1057.3.  Rules and Regulations for Personal Care
    12  [Home] Homes and Assisted Living Residences.--(a)  The rules and
    13  regulations for the licensing of personal care homes and
    14  assisted living residences promulgated by the department shall
    15  require that:

    17     (6)  For residents eligible for Supplemental Security Income


     1  (SSI) benefits, actual rent and other charges not exceed the
     2  resident's actual current monthly income reduced by a personal
     3  needs allowance for the resident in an amount to be determined
     4  by the department, but not less than [twenty-five dollars ($25)]
     5  one hundred twenty dollars ($120).

     7     Section 2.  Regulations, policy statements and orders of the
     8  Department of Public Welfare which are contrary to the amendment
     9  of section 1057.3(a)(6) of the act are abrogated to the extent
    10  of the inconsistency.
    11     Section 3.  This act shall take effect in 90 days.
