           DALEY, GOODMAN, FREEMAN, GIBBONS, CONKLIN, LENTZ, HORNAMAN,
           SURRA, MURT AND MAJOR, JANUARY 14, 2008

                                     AN ACT

     1  Amending the act of August 7, 1963 (P.L.549, No.290), entitled,
     2     as amended, "An act creating the Pennsylvania Higher
     3     Education Assistance Agency; defining its powers and duties;
     4     conferring powers and imposing duties on the Governor,
     5     President Pro Tempore of the Senate, Speaker of the House of
     6     Representatives, Superintendent of Public Instruction and the
     7     Department of Auditor General; and making appropriations,"
     8     providing for allocations to scholarship program.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of August 7, 1963 (P.L.549, No.290),
    12  referred to as the Pennsylvania Higher Education Assistance
    13  Agency Act, is amended by adding a section to read:
    14     Section 11.1.  (a)  Notwithstanding any other provision of
    15  this act, during the 2008-2009 fiscal year and each fiscal year
    16  thereafter the agency shall allocate to the scholarship program
    17  established under the act of January 25, 1966 (1965 P.L.1546,
    18  No.541), referred to as the Higher Education Scholarship Law, an
    19  amount equal to one hundred dollars ($100) for every one dollar
    20  (1$) spent on the following:

     1     (1)  Retreats for members of the board of directors or agency
     2  staff.
     3     (2)  Sponsorship of events or activities except those
     4  narrowly tailored to increase access to higher education
     5  opportunities for Pennsylvanians.
     6     (3)  Promotional materials and advertising, excluding
     7  brochures, mailings, forms or other documents describing agency
     8  programs.
     9     (4)  Bonuses awarded to employees of the agency or a
    10  nonprofit corporation established by the agency.
    11     (b)  The allocation shall be in addition to any amount
    12  appropriated by the General Assembly. For the purpose of this
    13  section, a bonus shall be any monetary compensation given to an
    14  employe above and beyond the employe's annual salary. The term
    15  does not include reimbursement for mileage and expenses for
    16  official business.
    17     Section 2.  This act shall take effect in 60 days.
