AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for restrictions on use of
3 highways and bridges.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4902(f) of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 4902. Restrictions on use of highways and bridges.

10 (f) [Actions to be in accordance with department] Department
11 regulations.--All actions taken under authority of this section
12 shall be taken in accordance with department regulations. The
13 department shall publish a revised schedule of bonding amounts
14 based on increased or decreased maintenance costs by January 1,
15 2009, and at least every three years thereafter. Furthermore,
16 department regulations shall, by January 1, 2009, reflect a
17 rebuttable presumption in favor of the municipality and against
18 the over-posted-weight permittee for damage sustained to posted
1 highways used by such permittee.

3 Section 2. This act shall take effect in 60 days.
