                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting mutilation of female
     3     genitalia.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3131.  Female mutilation.
     9     (a)  Offense defined.--A person commits female mutilation
    10  when:
    11         (1)  the person knowingly circumcises, excises or
    12     infibulates the whole or any part of the genitalia of a
    13     female; or
    14         (2)  the person is a parent, guardian or other person who


     1     is legally responsible for and charged with the care or
     2     custody of a female child 17 years of age or younger, and who
     3     allows the circumcision, excision or infibulation of the
     4     whole or any part of the female child's genitalia.
     5     (b)  Grading.--Female mutilation is a misdemeanor of the
     6  first degree.
     7     (c)  Exception.--A surgical operation is not a violation of
     8  this section if such operation is:
     9         (1)  necessary to the health of the person on whom it is
    10     performed and either is performed by a licensed physician or
    11     is performed in the presence of a licensed physician by a
    12     person in training to become a licensed physician; or
    13         (2)  performed on a person in labor or who has just given
    14     birth and is performed for medical reasons connected with
    15     that labor or birth by a licensed physician, by a licensed
    16     midwife or in the presence of a licensed physician by a
    17     person in training to become a licensed physician.
    18     Section 2.  This act shall take effect in 60 days.
