                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for advance payment
     3     of rates and interest on deposits.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 1305 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 1305.  Advance payment of rates; interest on deposits.
     9     (a)  General rule.--No public utility shall require the
    10  payment of rates in advance, or the making of minimum payments,
    11  ready to serve charges, or deposits to secure future payments of
    12  rates, except as the commission, by regulation or order, may
    13  permit. Any deposit made by any domestic consumer, under the
    14  provisions of this section or under any repealed statute
    15  supplied by this part, shall be returned with any interest due
    16  thereon to the consumer making such deposit when he shall have
    17  paid undisputed bills for service over a period of 12

     1  consecutive months.
     2     (b)  Reconnect charges for water supply.--Upon a sale of
     3  residential real estate upon which charges for water supply are
     4  outstanding and a disconnection has been made, the buyer may
     5  have water reconnected at no charge to the buyer. The collection
     6  of the disconnect/reconnect fee shall be borne solely by, and
     7  collectible solely from, the seller of the property.
     8     Section 2.  This act shall take effect in 60 days.
