AN ACT 1 Relieving certain employee organizations of certain duties and 2 obligations; and repealing the Public Employee Fair Share Fee 3 Law. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Limitation on collective bargaining agreements. 7 (a) General rule.--No collective bargaining agreement made 8 after the effective date of this section by any political 9 subdivision nor any extension of an existing collective 10 bargaining agreement made after the effective date of this 11 section by any political subdivision may require payment of a 12 fair share fee to the exclusive representative by a nonmember of 13 the exclusive representative. 14 (b) Employee organization representation of nonmembers.-- 15 Notwithstanding the provisions of section 606 of the act of July 16 23, 1970 (P.L.563, No.195), known as the Public Employe 17 Relations Act, or any other law to the contrary, an employee
1 organization acting as an exclusive representative shall owe no 2 duty and shall have no obligation to represent any public 3 employee who is not a member of the employee organization in any 4 grievance or other proceeding filed with or against a public 5 employer. 6 Section 2. Repeals. 7 Repeals are as follows: 8 (1) The General Assembly declares that the repeal under 9 paragraph (2) is necessary to effectuate this act. 10 (2) The act of June 2, 1993 (P.L.45, No.15), known as 11 the Public Employee Fair Share Fee Law, is repealed. 12 Section 3.
