                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor and the Department of
     3     Conservation and Natural Resources, to grant and convey to
     4     Jefferson County certain lands situate in Winslow Township,
     5     Jefferson County.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8  Section 1.  Conveyance in Winslow Township, Jefferson County.
     9     (a)  Authorization.--The Department of General Services, with
    10  the approval of the Department of Conservation and Natural
    11  Resources and the Governor, is hereby authorized and directed on
    12  behalf of the Commonwealth of Pennsylvania to grant and convey
    13  to Jefferson County certain lands, and any improvements thereon,
    14  situate in Winslow Township, Jefferson County for $750.00.
    15     (b)  Description of property.--The property to be conveyed
    16  pursuant to this section consists of approximately 1-acre of
    17  land, and all improvement thereon bounded more particularly
    18  described as follows:
    19     ALL that certain piece, parcel or tract of land situate,

     1  lying and being in Winslow Township, Jefferson County, bounded
     2  and described as follows:
     3     BEING a tract of one acre square, or 208 feet 6 inches on
     4  each side as surveyed and located on the ground, which tract is
     5  situate at the end of a private road and located 275 feet south
     6  of the boundary line between the said Norris and Horner lands as
     7  measured to the Northwest corner of piece herein described and
     8  1672 feet East of the district line between Knox and Winslow
     9  Townships.
    10     CONTAINING 1-acre, more or less.
    11     TOGETHER with any right, title or interest that the
    12  Commonwealth of Pennsylvania may have in a right-of-way leading
    13  from said 1-acre piece of ground northwesterly to lands of
    14  Charles Norris and thence to public road leading to
    15  Reynoldsville.
    16     (c)  Conditions.--The conveyance shall be made under and
    17  subject to all lawful and enforceable easements, servitudes and
    18  rights of others, including but not confined to streets,
    19  roadways and rights of any telephone, telegraph, water,
    20  electric, gas or pipeline companies, as well as under and
    21  subject to any lawful and enforceable estates or tenancies
    22  vested in third persons appearing of record, for any portion of
    23  the land or improvements erected thereon.
    24     (d)  Licensed facility prohibition.--Any conveyance
    25  authorized under this section shall be made under and subject to
    26  the condition, which shall be contained in the deed of
    27  conveyance, that no portion of the property conveyed shall be
    28  used as a licensed facility, as defined in 4 Pa.C.S. § 1103
    29  (relating to definitions), or any other similar type facility
    30  authorized under State law. The condition shall be a covenant

     1  running with the land and shall be binding upon the Grantee, its
     2  successors and assigns. Should the Grantee, its successors or
     3  assigns, permit any portion of the property authorized to be
     4  conveyed in this section to be used in violation of this
     5  subsection, the title shall immediately revert to and revest in
     6  the Grantor.
     7     (e)  Deed.--The deed of conveyance shall be by Special
     8  Warranty Deed and shall be executed by the Secretary of General
     9  Services in the name of the Commonwealth.
    10     (f)  Costs and fees.--Costs and fees incidental to this
    11  conveyance shall be borne by the Grantee.
    12  Section 2.  Effective date.
    13     This act shall take effect immediately.
