AN ACT
1 Authorizing the Department of General Services, with the
2 approval of the Governor, to grant and convey, separately, to
3 The Pennsylvania State University, Benner Township and the
4 Pennsylvania Fish and Boat Commission certain lands situate
5 in Benner Township, Centre County.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Conveyance to The Pennsylvania State University in
9 Benner Township, Centre County, Pennsylvania.
10 (a) Authorization.--The Department of General Services, with
11 the approval of the Governor, is hereby authorized on behalf of
12 the Commonwealth of Pennsylvania to grant and convey to The
13 Pennsylvania State University certain land and improvements
14 situate in Benner Township, Centre County for $1,013,627 and
15 under terms and conditions to be established in an Agreement of
16 Sale with the Department of General Services.
17 (b) Description.--The property to be conveyed pursuant to
18 subsection (a) consists of six parcels totaling 1,124.1858 acres
19 and improvements thereon bounded and more particularly described

3 ALL THAT CERTAIN PARCEL or tract of land situated in Benner
4 Township, Centre County, Pennsylvania, shown as "Parcel 1.1" on

7 Property at the State Correctional Institution at Rockview",

17 Grantees mission of education related to agricultural sciences.
18 Should the Grantee attempt to convey the property, or utilize it
19 for any other purpose, the property shall immediately revert to
20 the Grantor."
21 (e) Gaming facility restriction.--Any conveyance authorized
22 under this section shall be made under and subject to the
23 condition, which shall be contained in the deed of conveyance,
24 that no portion of the property conveyed shall be used as a
25 licensed facility as defined in 4 Pa.C.S. § 1103 (relating to
26 definitions) or any other similar type of facility authorized
27 under State law. The condition shall be a covenant running with
28 the land and shall be binding upon the Grantee, its successors
29 and assigns. Should the Grantee, its successors or assigns,
30 permit any portion of the property authorized to be conveyed in

1 this section to be used in violation of this subsection, the
2 title shall immediately revert to and revest in the Grantor.
3 (f) Execution.--The deed of conveyance shall be by Special
4 Warranty Deed and shall be executed by the Secretary of General
5 Services in the name of the Commonwealth.
6 (g) Costs and fees.--Costs and fees incidental to this
7 conveyance shall be borne by the Grantee.
8 (h) Nonconveyance.--In the event that this conveyance is not
9 executed within 12 months of the effective date of this section,
10 the authority contained herein shall expire.
11 Section 2. Conveyance to Benner Township in Benner Township,
12 Centre County, Pennsylvania.
13 (a) Authorization.--The Department of General Services, with
14 the approval of the Governor, is hereby authorized on behalf of
15 the Commonwealth of Pennsylvania to grant and convey to Benner
16 Township certain land and improvements situate in Benner
17 Township, Centre County for $1 and under terms and conditions to
18 be established in an Agreement of Sale with the Department of
19 General Services.
20 (b) Description.--The property to be conveyed pursuant to

1 (c) Easements.--The conveyance shall be made under and
2 subject to all lawful and enforceable easements, servitudes and
3 rights of others, including but not confined to streets,
4 roadways and rights of any telephone, telegraph, water,
5 electric, gas or pipeline companies, as well as under and
6 subject to any lawful and enforceable estates or tenancies
7 vested in third persons appearing of record, for any portion of
8 the land or improvements erected thereon.
9 (d) Land use restriction.--The deed of conveyance shall
10 contain the following restrictive covenant: "Under and subject
11 to a restriction that the land conveyed herein shall be used
12 solely for passive recreational open space for the benefit of
13 the public at large. Should the Grantee attempt to convey the
14 property, or utilize it for any other purpose, the property
15 shall immediately revert to the Grantor."
16 (e) Gaming facility restriction.--Any conveyance authorized
17 under this section shall be made under and subject to the
18 condition, which shall be contained in the deed of conveyance,
19 that no portion of the property conveyed shall be used as a
20 licensed facility as defined in 4 Pa.C.S. § 1103 (relating to
21 definitions) or any other similar type of facility authorized
22 under State law. The condition shall be a covenant running with
23 the land and shall be binding upon the Grantee, its successors
24 and assigns. Should the Grantee, its successors or assigns,
25 permit any portion of the property authorized to be conveyed in
26 this section to be used in violation of this subsection, the
27 title shall immediately revert to and revest in the Grantor.
28 (f) Execution.--The deed of conveyance shall be by Special
29 Warranty Deed and shall be executed by the Secretary of General
30 Services in the name of the Commonwealth.

1 (g) Costs and fees.--Costs and fees incidental to this
2 conveyance shall be borne by the Grantee.
3 (h) Nonconveyance.--In the event that this conveyance is not
4 executed within 12 months of the effective date of this section,
5 the authority contained in this section shall expire.
6 Section 3. Conveyance to the Pennsylvania Fish and Boat
7 Commission in Benner Township, Centre County,
8 Pennsylvania.
9 (a) Authorization.--The Department of General Services, with
10 the approval of the Governor, is hereby authorized on behalf of
11 the Commonwealth of Pennsylvania to grant and convey to the
12 Pennsylvania Fish and Boat Commission certain land and
13 improvements situate in Benner Township, Centre County for $1.
14 (b) Description.--The property to be conveyed pursuant to
15 subsection (a) consists of three parcels totaling 59.2415 acres
16 and improvements thereon bounded and more particularly described

3 (c) Easements.--The conveyance shall be made under and
4 subject to all lawful and enforceable easements, servitudes and
5 rights of others, including but not confined to streets,
6 roadways and rights of any telephone, telegraph, water,
7 electric, gas or pipeline companies, as well as under and
8 subject to any lawful and enforceable estates or tenancies
9 vested in third persons appearing of record, for any portion of
10 the land or improvements erected thereon.
11 (d) Land use restriction.--The deed of conveyance shall
12 contain the following restrictive covenant: "Under and subject
13 to a condition that the land conveyed herein shall be used
14 solely by the Pennsylvania Fish and Boat Commission to carry out
15 their legislatively mandated functions and for no other purpose.
16 Should the Grantee attempt to convey the property, or utilize it
17 for any other purpose, the property shall immediately revert to
18 the Grantor."
19 (e) Gaming facility restriction.--Any conveyance authorized
20 under this section shall be made under and subject to the
21 condition, which shall be contained in the deed of conveyance,
22 that no portion of the property conveyed shall be used as a
23 licensed facility as defined in 4 Pa.C.S. § 1103 (relating to
24 definitions) or any other similar type of facility authorized
25 under State law. The condition shall be a covenant running with
26 the land and shall be binding upon the Grantee, its successors
27 and assigns. Should the Grantee, its successors or assigns,
28 permit any portion of the property authorized to be conveyed in
29 this section to be used in violation of this subsection, the
30 title shall immediately revert to and revest in the Grantor.

1 (f) Execution.--The deed of conveyance shall be by Special
2 Warranty Deed and shall be executed by the Secretary of General
3 Services in the name of the Commonwealth of Pennsylvania.
4 (g) Costs and fees.--Costs and fees incidental to this
5 conveyance shall be borne by the Grantee.
6 (h) Nonconveyance.--In the event that this conveyance is not
7 executed within 12 months of the effective date of this section,
8 the authority contained in this section shall expire.
9 Section 4. Effective date.
10 This act shall take effect in 60 days.
