AN ACT
1 Authorizing and directing the Department of General Services,
2 with the approval of the Department of Conservation and
3 Natural Resources and the Governor, to grant and convey to
4 Skippack Township certain lands situate in Skippack Township,
5 Montgomery County, in exchange for Skippack Township granting
6 and conveying certain lands to the Commonwealth to be added
7 to those existing lands at Evansburg State Park; AND <--
8 AUTHORIZING AND DIRECTING THE DEPARTMENT OF GENERAL SERVICES,
9 WITH THE APPROVAL OF THE GOVERNOR AND THE DEPARTMENT OF
10 CONSERVATION AND NATURAL RESOURCES, TO GRANT AND CONVEY TO
11 JEFFERSON COUNTY CERTAIN LANDS SITUATE IN WINSLOW TOWNSHIP,
12 JEFFERSON COUNTY; AND AUTHORIZING AND DIRECTING THE <--
13 DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
14 GOVERNOR AND THE DEPARTMENT OF MILITARY AND VETERANS AFFAIRS,
15 TO GRANT AND CONVEY TO THE BOROUGH OF MANSFIELD CERTAIN LANDS
16 SITUATE IN THE BOROUGH OF MANSFIELD, TIOGA COUNTY.
17 The General Assembly of the Commonwealth of Pennsylvania
18 hereby enacts as follows:
19 Section 1. Conveyance in Skippack Township, Montgomery County.
20 (a) Authorization.--The Department of General Services, with
21 the approval of the Department of Conservation and Natural
22 Resources and the Governor, is hereby authorized on behalf of
23 the Commonwealth of Pennsylvania to grant and convey to Skippack
24 Township, free of restrictions on use and alienation imposed by
1 section 20 of the act of June 22, 1964 (Sp. Sess., P.L.131,
2 No.8), known as the Project 70 Land Acquisition and Borrowing
3 Act, certain lands situate in Skippack Township, Montgomery
4 County, in exchange for that certain property to be conveyed to
5 the Commonwealth of Pennsylvania in accordance with subsection
6 (c).
7 (b) Description of property to be transferred to Skippack
8 Township.--The property to be conveyed in accordance with
9 subsection (a) consists of eight tracts of land totaling
10 approximately 0.5709-acres and improvements thereon bounded and
11 more particularly described as follows:

13 BEGINNING AT A POINT west of the corner of Skippack Pike (SR
14 0073) and Old Forty Foot Road (SR 1006) as shown on the plan
15 prepared by Traffic Planning and Design, Inc., Pottstown,
16 Pennsylvania dated October 25, 2006 said point being 16.49 feet
17 right of station 47+85.00,

8 (c) Conveyance of property to Commonwealth.--The Department
9 of General Services, with the approval of the Department of
10 Conservation and Natural Resources and the Governor, is hereby
11 authorized on behalf of the Commonwealth of Pennsylvania to
12 receive from Skippack Township certain lands situate in Skippack
13 Township, Montgomery County, in exchange for that property to be
14 conveyed to the Township in accordance with subsection (a).
15 (d) Description of property to be transferred to
16 Commonwealth.--The property to be conveyed in accordance with
17 subsection (c) consists of approximately 0.5418-acres and
18 improvements thereon bounded and more particularly described as
19 follows:
20 BEGINNING AT A POINT, a spike in the centerline of Thompson
21 Road, also known as Lesher Road, said point being located the
22 following two (2) courses and distances from the intersection of
23 the centerlines of Thompson Road and Mayhall Road:
24 1. North 65 degrees 29 minutes 06 seconds West, a distance
25 of 276.43 feet, to a point;
26 2. North 60 degrees 46 minutes 51 seconds West, a distance
27 of 579.56 feet, to a point;
28 THENCE, from said beginning point, and leaving said Thompson
29 Road and through property of the Township of Skippack (Block 34,
30 Unit 1), of which this parcel is a part, North 47 degrees 56

14 (e) Conditions of conveyances.--The conveyances described in
15 this section shall be made concurrently and under and subject to
16 all lawful and enforceable easements, servitudes and rights of
17 others, including but not confined to streets, roadways and
18 rights of any telephone, telegraph, water, electric, gas or
19 pipeline companies, as well as under and subject to any lawful
20 and enforceable estates or tenancies vested in third persons
21 appearing of record, for any portion of the land or improvements
22 erected thereon.
23 (f) Restrictive covenants.--
24 (1) The Department of Conservation and Natural
25 Resources, with the approval of the Department of General
26 Services, shall impose and record Project 70 restrictions on
27 the property to be conveyed in accordance with subsection
28 (c).
29 (2) Any conveyance authorized under subsection (a) shall
30 be made under and subject to the condition, which shall be

1 contained in the deed of conveyance, that no portion of the
2 property conveyed to Skippack Township shall be used as a
3 licensed facility, as defined in 4 Pa.C.S. § 1103 (relating
4 to definitions), or any other similar type of facility
5 authorized under State law. The condition shall be a covenant
6 running with the land and shall be binding upon Skippack
7 Township, its successors and assigns. Should Skippack
8 Township, its successors or assigns, permit any portion of
9 the property authorized to be conveyed to the Township in
10 this act to be used in violation of this subsection, the
11 title shall immediately revert to and revest in the
12 Commonwealth of Pennsylvania.
13 (g) Temporary construction easement.--
14 (1) For the duration of the construction of the Project,
15 temporary easements shall be granted by the Department of
16 General Services, with the approval of the Department of
17 Conservation and Natural Resources and the Governor, to
18 Skippack Township, or its designee, for the purpose of
19 facilitating the construction of this Project, which
20 easements are described as follows:
