AN ACT
1 Authorizing and directing the Department of General Services,
2 with the approval of the Department of Conservation and
3 Natural Resources and the Governor, to grant and convey to
4 Skippack Township certain lands situate in Skippack Township,
5 Montgomery County, in exchange for Skippack Township granting
6 and conveying certain lands to the Commonwealth to be added
7 to those existing lands at Evansburg State Park.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Conveyance in Skippack Township, Montgomery County.
11 (a) Authorization.--The Department of General Services, with
12 the approval of the Department of Conservation and Natural
13 Resources and the Governor, is hereby authorized on behalf of
14 the Commonwealth of Pennsylvania to grant and convey to Skippack
15 Township, free of restrictions on use and alienation imposed by
16 section 20 of the act of June 22, 1964 (Sp. Sess., P.L.131,
17 No.8), known as the Project 70 Land Acquisition and Borrowing
18 Act, certain lands situate in Skippack Township, Montgomery
19 County, in exchange for that certain property to be conveyed to
20 the Commonwealth of Pennsylvania in accordance with subsection
1 (c).
2 (b) Description of property to be transferred to Skippack
3 Township.--The property to be conveyed in accordance with
4 subsection (a) consists of eight tracts of land totaling
5 approximately 0.5709-acres and improvements thereon bounded and
6 more particularly described as follows:

8 BEGINNING AT A POINT west of the corner of Skippack Pike (SR
9 0073) and Old Forty Foot Road (SR 1006) as shown on the plan
10 prepared by Traffic Planning and Design, Inc., Pottstown,
11 Pennsylvania dated October 25, 2006 said point being 16.49 feet
12 right of station 47+85.00,

3 (c) Conveyance of property to Commonwealth.--The Department
4 of General Services, with the approval of the Department of
5 Conservation and Natural Resources and the Governor, is hereby
6 authorized on behalf of the Commonwealth of Pennsylvania to
7 receive from Skippack Township certain lands situate in Skippack
8 Township, Montgomery County, in exchange for that property to be
9 conveyed to the Township in accordance with subsection (a).
10 (d) Description of property to be transferred to
11 Commonwealth.--The property to be conveyed in accordance with
12 subsection (c) consists of approximately 0.5418-acres and
13 improvements thereon bounded and more particularly described as
14 follows:
15 BEGINNING AT A POINT, a spike in the centerline of Thompson
16 Road, also known as Lesher Road, said point being located the
17 following two (2) courses and distances from the intersection of
18 the centerlines of Thompson Road and Mayhall Road:
19 1. North 65 degrees 29 minutes 06 seconds West, a distance
20 of 276.43 feet, to a point;
21 2. North 60 degrees 46 minutes 51 seconds West, a distance
22 of 579.56 feet, to a point;
23 THENCE, from said beginning point, and leaving said Thompson
24 Road and through property of the Township of Skippack (Block 34,
25 Unit 1), of which this parcel is a part, North 47 degrees 56
26 minutes 45 seconds East, a distance of 943.86 feet, to a point
27 in line of lands now or formerly of Peco Energy (Block 34, Unit
28 13 10);
29 THENCE, along said lands of Peco Energy, South 53 degrees 21
30 minutes 24 seconds East, a distance of 51.00 feet, to a point, a

7 CONTAINING in area 23,601.75 Square Feet or 0.5418 acres,
8 more or less.
9 (e) Conditions of conveyances.--The conveyances described in
10 this section shall be made concurrently and under and subject to
11 all lawful and enforceable easements, servitudes and rights of
12 others, including but not confined to streets, roadways and
13 rights of any telephone, telegraph, water, electric, gas or
14 pipeline companies, as well as under and subject to any lawful
15 and enforceable estates or tenancies vested in third persons
16 appearing of record, for any portion of the land or improvements
17 erected thereon.
18 (f) Restrictive covenants.--
19 (1) The Department of Conservation and Natural
20 Resources, with the approval of the Department of General
21 Services, shall impose and record Project 70 restrictions on
22 the property to be conveyed in accordance with subsection
23 (c).
24 (2) Any conveyance authorized under subsection (a) shall
25 be made under and subject to the condition, which shall be
26 contained in the deed of conveyance, that no portion of the
27 property conveyed to Skippack Township shall be used as a
28 licensed facility, as defined in 4 Pa.C.S. § 1103 (relating
29 to definitions), or any other similar type of facility
30 authorized under State law. The condition shall be a covenant

1 running with the land and shall be binding upon Skippack
2 Township, its successors and assigns. Should Skippack
3 Township, its successors or assigns, permit any portion of
4 the property authorized to be conveyed to the Township in
5 this act to be used in violation of this subsection, the
6 title shall immediately revert to and revest in the
7 Commonwealth of Pennsylvania.
8 (g) Temporary construction easement.--

11 General Services, with the approval of the Department of
12 Conservation and Natural Resources and the Governor, to

19 (2) The easements shall terminate and revert back to the
20 Commonwealth of Pennsylvania, when the necessary construction of
21 the improvements has been completed, but not more than five
22 years from the effective date of this section.
23 (h) Deeds of conveyance.--The deed for the conveyance of the
24 property in accordance with subsections (a) and (c) shall be by
25 Special Warranty Deed and shall be executed by the Secretary of
26 General Services in the name of the Commonwealth of
27 Pennsylvania.
28 (i) Costs and fees.--All costs and fees incidental to the
29 conveyances contained in this section shall be borne by Skippack
30 Township.

1 (j) Alternate disposition.--In the event that these
2 conveyances are not executed within 12 months of the effective
3 date of this section, the authorization contained in this
4 section shall become null and void.
5 Section 2. Effective date.
6 This act shall take effect immediately.
