        AS REPORTED FROM COMMITTEE ON LABOR RELATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 23, 2007

                                     AN ACT

     1  Amending the act of December 18, 1984 (P.L.1004, No.204),
     2     entitled "An act extending benefits to police chiefs or heads
     3     of police departments of political subdivisions of the
     4     Commonwealth who have been removed from bargaining units by
     5     the Pennsylvania Labor Relations Board," further providing
     6     for definitions and for salary of supervisory personnel        <--
     7     SALARY OF NONUNION POLICE OFFICERS.                            <--

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1 of the act of December 18, 1984
    11  (P.L.1004, No.204), entitled "An act extending benefits to
    12  police chiefs or heads of police departments of political
    13  subdivisions of the Commonwealth who have been removed from
    14  bargaining units by the Pennsylvania Labor Relations Board," is
    15  repealed AMENDED TO READ:                                         <--
    16  [Section 1.  Salary of nonunion police officers.                  <--
    17     Except in cities of the first and second class, the chief,
    18  superintendent or commissioner of police and other ranking
    19  officers in a political subdivision of the Commonwealth who have

     1  been removed from bargaining units under the act of June 24,
     2  1968 (P.L.237, No.111), referred to as the Policemen and Firemen
     3  Collective Bargaining Act, by rulings of the Pennsylvania Labor
     4  Relations Board shall receive not less than the same dollar
     5  increase including fringe benefits excluding overtime and
     6  festive holiday pay as received by the highest ranking police
     7  officer participating in the bargaining unit.]
     8     Section 2.  The act is amended by adding sections to read:
     9  Section 1.1.  Definitions.
    10     The following words and phrases when used in this act shall
    11  have the meanings given to them in this section unless the
    12  context clearly indicates otherwise:
    13     "Bargaining unit."  A collective bargaining unit as provided
    14  under the act of June 24, 1968 (P.L.237, No.111), referred to as
    15  the Policemen and Firemen Collective Bargaining Act.
    16     "Supervisory personnel."  The chief, superintendent or
    17  commissioner of police and other ranking police officers in a
    18  political subdivision of the Commonwealth, except that this term
    19  does not apply to those individuals employed by cities of the
    20  first and second class.
    21  Section 1.2.  Salary of supervisory personnel.
    22     (a)  Pay and benefits.--Supervisory personnel who are not
    23  members of bargaining units shall receive not less than the same
    24  dollar increase including fringe benefits excluding overtime and
    25  festive holiday pay as received by the highest ranking police
    26  officer participating in the bargaining unit.
    27     (b)  Additional persons.--Supervisory personnel who have been
    28  removed from bargaining units by rulings of the Pennsylvania
    29  Labor Relations Board shall be subject to the provisions of
    30  subsection (a).

     1     (c)  Future personnel.--Supervisory personnel who are not
     2  members of bargaining units and who have not been removed from
     3  bargaining units by rulings of the Pennsylvania Labor Relations
     4  Board shall be subject to the provisions of subsection (a),
     5  unless the governing body of the political subdivision, by
     6  majority vote of the members elected to the governing body,
     7  provides for a lesser annual increase or for no annual increase.
     8     Section 3.  (a)  Section 1.2(a) of the act shall apply to
     9  supervisory personnel who are appointed to their positions prior
    10  to the effective date of this section.
    11     (b)  Sections 1.2(b) and (c) of the act shall apply to
    12  supervisory personnel who are appointed to their positions on or
    13  after the effective date of this section.
    14     Section 4.  This act shall take effect in 60 days.
    15  SECTION 1.  SALARY OF NONUNION POLICE OFFICERS.                   <--
    16     (A)  GENERAL RULE.--EXCEPT IN CITIES OF THE FIRST AND SECOND
    17  CLASS, THE CHIEF, SUPERINTENDENT OR COMMISSIONER OF POLICE AND
    18  OTHER RANKING OFFICERS IN A POLITICAL SUBDIVISION OF THE
    19  COMMONWEALTH WHO [HAVE BEEN REMOVED FROM] ARE NOT MEMBERS OF
    20  BARGAINING UNITS UNDER THE ACT OF JUNE 24, 1968 (P.L.237,
    21  NO.111), REFERRED TO AS THE POLICEMEN AND FIREMEN COLLECTIVE
    22  BARGAINING ACT, [BY RULINGS OF THE PENNSYLVANIA LABOR RELATIONS
    23  BOARD] SHALL RECEIVE NOT LESS THAN THE SAME DOLLAR INCREASE
    24  INCLUDING FRINGE BENEFITS EXCLUDING OVERTIME AND FESTIVE HOLIDAY
    25  PAY AS RECEIVED BY THE HIGHEST RANKING POLICE OFFICER
    26  PARTICIPATING IN THE BARGAINING UNIT.
    27     (B)  DEFINITION.--AS USED IN THIS SECTION, THE TERM
    28  "BARGAINING UNIT" MEANS A COLLECTIVE BARGAINING UNIT AS PROVIDED
    29  UNDER THE POLICEMEN AND FIREMEN COLLECTIVE BARGAINING ACT.
    30     SECTION 2.  THIS ACT SHALL TAKE EFFECT IN 60 DAYS.
